If they aren't going to charge him then yes they should give him his bullets back. It really goes back further if the guy is a POS and keeps skating that is the problem not giving him his bullets after failing to charge him.

No way that prosecution would have stuck. So, this is the classic NES catch-22: prosecute maliciously and remove RKBA, all while knowing there's no case? Or affirm a god-given RKBA, despite the dead people and the armed illegal?

Under the circumstances, faced with an unwinnable case and no arrest (let alone conviction), I'm generally in favor of the State NOT ganking peoples' guns, no matter what.

The issue is that the DA isn't doing the job she swore to do.

So you personally know the circumstances of the case???? You know all of the evidence the DA reviewed??? You know she just lazily kicked the case instead of hitting a massive brick wall.

This isn't Law & Order here. The burden of proof is a lot higher in court than we're shown on TV.

Hell, I'd argue why a convicted felon had a gun in the first place. . . . . but I'm a 2A believer and if he served his time, he shouldn't be denied ANY of his rights. Can he vote? Then he can own a gun. And clearly in his state they don't consider it a big deal anyhow.

This is MMQB at it's best. Without any data, we can't determine if she screwed up or not. We just got feelings. And if we get any more feelings, we'll all end up voting for Joltin Joe in 12 days.

I don't have any problem with someone serving their sentence and getting rights back but when someone who is here illegally and has no right to own a gun because of his immigration status kills someone ,I have a problem with that.

I'm ok with genocide. In fact, I think an excellent stimulus program to lift us out of the plandemic depression would be to offer a $1000 bounty on illegal immigrants.

I understand what you're saying, but you're living in fairyland. None of what you want reflects reality. The courts have to deal with reality, not feels. The reality here is that these charges weren't going to stick. Not some other charges... not what he "should" have been charged with... THESE charges.

And if the charges aren't going to stick, the defendant gets kicked loose. And if the defendant is loose, he absolutely has the right to have his gun. What he chose to do with it is his fault, and he'll hopefully pay a price for it.
 
but I don't think illegal aliens have the right to possess a firearm. Isn't that one of the questions we check off on our 45whatever form when we buy a gun? Am I wrong here?

The letter "R" in "RKBA" stands for something important.

With that said, I have no idea what the law is in TX regarding possession. But I think (correct me if I'm wrong) the DA didn't let him have a gun back, just ammo. Which must be lawful. And I don't think he was carrying said gun...
