3 more weeks until the change to chapter 140 that Sen. Timilty and I put up and got passed to not only help C&R licensees but actually gets Mass to recognize C&R licenses!
We did this 6 years ago and even recently I had a dealer tell me that since MA doesn't recognize C&R's he cannot transfer a gun that is not MA compliant since the C&R regulations (federally) state that you have to follow all state laws which means a dealer legally cannot transfer a non-compliant gun that is a C&R to you. NOW MOST DO but technically they can't.
Now there will be no issue, if you want to buy a C&R gun and for some reason the dealer won't sell it just show them this section. For example I have had dealers that won't send to a C&R (incorrectly) or an individual that only will send to a dealer or go through a dealer and then the dealer says it is not MA compliant, well this fixes all that.
I realize it seldom happens but this just locks it in.
Here is the new law in Chapter 140 Section 131 E
A firearms collector, licensed pursuant to 18 U.S.C. 923(b), may purchase a rifle, shotgun or firearm that was not previously owned or registered in the commonwealth from a dealer licensed under section 122 if that rifle, shotgun or firearm is a curio or relic as defined in 27 CFR 478.11.
