A small civilian gun club located just 50 miles northwest of Boston has won a “landmark” lawsuit against nearby Fort Devens for violating their rights and federal law by denying them access to military rifle ranges at reasonable rates.

The Ft. Devens Rifle & Pistol Club, Inc., filed suit in 2022 claiming that Fort officials were charging range fees in violation of federal law, according to club treasurer Jim Gettens, a retired attorney who assisted with the legal fight.

Gettens said Monday that his club’s victory was a major “David vs. Goliath” event.

 
10 USC 7409 is little known, and should be invoked more.

After 9/11 when everyone wanted to lock everything down, I used it to get Red River Army Depot to back off their new policy that banned access. I also worked for a federal agency that had their own rifle and pistol ranges (not in a secure area, but directly accessible from a public road with no locks or gates), and used it to beat up the chief of law enforcement when he trotted out a new policy banning even off duty staff from using the ranges.
 
Don't they have a 1000 yard rifle range?
I've been there a bunch of times to use the ranges for weapon qual in the army....I know the Marine corps known distance rifle range is a long one but I don't know the exact distance.....but it is definitely what most shooters would call "long range".

There is a 500 yard range with pits, and then a (couple?) 300 meter pop up target range. Along with some shorter ranges.

Back when I was a member, there was a 600 yard known distance range (Golf range) with pits. There was also a machine gun range with popup targets out to ~800 yards (Hotel range).

I gave up my membership when a new base commander decided that gun club members couldn’t drive their personal vehicles on base but could only carpool in.

The rifle ranges club used when I was there was 600 known distance with pits, then 1000+ yard with knock down pop ups

Yup, you’re right. I thought it was just 500, but the known distance is 600 yards. The first line next to the divider berm is 500, but you can back it up closer to the road for 600.

Yup, you’re right. I thought it was just 500, but the known distance is 600 yards. The first line next to the divider berm is 500, but you can back it up closer to the road for 600.

The only ranges i ever used were the machine gun zero down in that pit off the left side of the range road, the machine gun qual range, and of course the m16 zero and pop up ranges....and the pistol qual range. I've been by the marine kd range a million times but of course never used it. It's a very good complex at defense for weapon training. I used to hunt devens every year for deer and turkey but many years ago the post commanders started making you register your hunting guns with the dod police to bring them in to hunt.....and the only hours were mon to fri business hours to do that and I didn't want to take time off work to do that.....so I gave up on devens hunting. Shame too......always tagged out at devens for many years.

There is a patch of swamp off the side of a power line up near training area 9 we used to always go......deer packed in that swamp like rats. On one drive I counted 20 deer come out of that swamp accross the power lines into the woods on the other side.....too far for me to take a poke but we moved them out of those woods and the crew dropped 4 of em a few minutes later.

Shit in still have the waypoint marked where we'd park the trucks and get the drives set up.

My son got his first deer and first turkey at devens......one of the trips my son and I doubled up and got a buck each on the same drive. Those were the days!

so, all in all, does it mean anything at all, is devens now be open for us to shoot, or is it still just an another BS that will not mean anything?

My guess is that the base commander will add some additional limitations that make it effectively impossible to use. For example, you can only use the ranges on Tuesdays, but only if you reserve months in advance, and you can be bumped by any military or law enforcement agency. And you have to park your cars at the gate and all members have to go in and leave at the same time, and you will be shuttled in by Army vans that you have to reserve ahead of time, which, of course, won’t be available when you actually get there.

There was a range to the right of Golf, between Golf and Hotel, that had been used for mortars and was closed due to UXO. So lead abatement would not be the only issue.
Ya, those usually end up posted as permanently off limits to any access. Fort Hood and Fort Sill have very large ones from mortars, artillery and aircraft ordnance. They'll likely never be reclaimed as there's been lots of stuff fired in there for many decades.

I believe there is (was?) an artillery range elsewhere on Devens that would also have UXO.

The only access I know of before the lawsuit was organized activities of the Ft Devens Rifle and Pistol club. Usually one a month at one of rifle ranges and another once a month at pistol/ short distance range. Yes it was on a weekday.

You needed to be member or guest of member

I have no idea of what it will be going forward, You would need to ask current club member about that ( and they may not know yet)

They stopped letting anyone drive PoV onto south post around like 2005ish? Even commanders of units training had to park and call for a ride.
Hotel range said right in the range packet to sand bag the buttsocks of weapons of inexperienced soldiers, because you could practice a plunging fire beaten zone in Littleton if they shot over the berm. lol

And not for nothing, the KD range was like 600-800 meters in the morning, then by the end of the day it was for sure 11 miles from the first line to the pit.

I just got an email couple weeks ago (still in the distro I guess) that South Post is closed for training, period.

The no pov on south post was for military taking part in training......i remember all of that.......that was because units using south post for training would end up with a shit ton of officers and sr. Ncos out there in their personal vehicles and was getting crazy the number of povs out there. I hunted devens up till about 2019 and when taking part in the hunting program we could drive through south post.....but had a big permit we had to tape to the passenger side windshield.

Also....

Do you mean south post is closed to all training right now? No military or police training at all? Because I have devens rfta on my fb feed and they are still posting updates on training events.....even yesterday they had a marine unit using the ranges.

I read it wrong- it’s just the TTB. not south post whole. TTB closes May 19
