Me too, although it doesn't look good. I guess he could try to claim it's just her word that they had sex and he paid her $500. Although, would anyone believe it? The article indicates the security cameras and other evidence show she was in the hotel with him for 50 minutes, so that's about right for screwing around. Age of consent in Texas is 17, and she's 16... I wonder how close to 17 at the time. Calling her the "victim" is absurd... you don't go to a "sugar daddy" site accidentally and just stumble into the hotel room with some guy. But if they have the sex pics, he's totally screwed and her word doesn't matter any more. It's probably a good idea if he stayed outside the country. He will not get a fair trial.

Right, which is why in most places there's the "knowingly" element to such a charge.

I'm not saying it should be as simple as "knowingly" penetrating a child, or whatever it is state by state (that's what he's charged with in TX - there's a big loophole there; just don't ask.)

All I'm saying is that being there are "kids" who look like adults, and vice versa, and there's apparently no shortage of "children" driving cars with real IDs, using their fake IDs to buy booze, and then meeting men THEY SOLICITED using 18+ services, maybe there should be a small loophole for being actively deceived. Especially when a hundred miles east there would be no crime because in most states it's 16, in a few it's 17, and very rarely it's 18.

If you have drinks with someone you met using an 18+ dating service and they turn out to be underage, it sounds like, in order, this is the fault of the underage person, the dating service, the bar for serving on a fake ID, and then yourself (and even then, not much - can you run a CORI on every person you date?)...

Charge the dude for solicitation, fine. I wonder if he'd have a civil suit against the website AND the "victim" here.

One thing worth noting, I didn't see any age verification requirement mentioned on the site.
I could have easily missed it, but when I signed up all I had to do was verify my email address... that was it.
Even if age verification was required, it's easily faked.

Within days of filing for state rep, I started getting something entirely different: articulately-written and suggestive texts along the line of, "You've been on my mind a lot lately. Can we meet up?"

I have a healthy amount of paranoia, so I just laughed. I'm also a very happily married middle aged guy and not interested in stepping out. (Very early on, my lovely bride told me that if I ever screwed up, the punishment wouldn't be divorce... it would be having to live with her pissed off at me every single day for the rest of my life. ;) )

So yeah, even if you're a first-time candidate for an office with no real power, you have to be aware of such things.

Exactly. I'd say leave out intent, but a "loophole" for victims of obvious efforts to conceal or misrepresent age (fake ID, age restricted services, etc).

Texas has the same law as NH I believe. If the "victim" is a minor (anyone under 18, regardless of what the age of consent is, TX it is 17 and NH it is 16) and they accept money for the sex, it is not only a felony, but the lack of knowledge of age is banned as a valid defense.

Oh come on. Intent has been part of criminal law literally forever. Go look up mens rea and think about what you've said here. Hell, the difference between murder and manslaughter is intent.
