Special Instructions for Individuals, Trusts and Legal Entities

FILING AS AN INDIVIDUAL
The applicant must attach a digital photo in the Photo function on the Responsible Person tab.
The applicant must also provide his or her fingerprints on Form FD-258. The fingerprints will be submitted separately from the application. Upon submission of the application, the eForms system will email a cover sheet to the applicant. The cover sheet is to be printed as it will provide the control number of the transaction and the address where to send the fingerprint cards. The cover sheet and fingerprint cards MUST be mailed to the NFA Division within 10 business days of filing the application.

FILING AS A TRUST OR OTHER LEGAL ENTITY
In addition to providing the documentation of the existence of the trust or other legal entity, the applicant must electronically provide a photograph and completed ATF Form 5320.23, NFA Responsible Person Questionnaire (RPQ), for each responsible person (see definition 1.e on the instruction page) of the trust or legal entity. When filed via eForms, when in the Responsible Person function, the applicant will identify each responsible person and attach the photograph and a scanned, signed RPQ from that person. All photographs and RPQ forms must be attached to the application prior to submission.

The fingerprints for each responsible person must also be submitted. As for an individual applicant, the fingerprint cards must be sent to the NFA Division. The eForms system will email a cover sheet to the applicant listing the names of the responsible persons and is to be printed. The cover sheet and the fingerprint cards for all RP's MUST be mailed in one batch to the NFA Division within 10 days of filing the application.

Please note that the F 5320.23, NFA RPQ, form is available in a fillable version on the ATF website (www.atf.gov). The form can be completed and printed for signature and scanning.
 
if you have to send the print form then what is the advantage?
It only appears you need to submit finger prints in paper. Not the whole form. Generally eletonic submissions are processed faster than paper ones (still takes forever). Only real difference is an electronic application you don’t get back a physical stamp.

I have yet to submit one since the change. But thinking it’s time for a Bren 805 SBR

Do you need to send prints again if using a trust that already has received a stamp 4 years ago?

It all changed under obama. I know they now require prints for every person in the trust. (to prove there are not any prohibited persons within the trust, EVEN THOUGH that is already a crime). If you are the only person in your trust I am not sure how that would play out. I would think they would want prints re sent ever since the obama ruling. I am not certain but I think they want the prints every time a form is submitted, but I am no expert on the matter. When I do another I will get in touch with Rock Maple since I did my trust with him.

I would also be interested to see what the pros/cons of a trust vs individual would be now. Before a trust was in theory the only legal way around a CLEO sign off.
 
Are there any idiots guides to doing these since all the changes? I haven’t submitted for a stamp in years... I’d be intested in thoughts on trust vS individual too
 
Even though I have a trust, I wonder if it would be better to apply as an individual and only submit my prints. Can it be added to the trust after?

Sure, but that's a transfer, on a Form 4, with the $200 tax and all the Form 4 requirements, just as if the trust had bought it at a dealer, or if you had transferred it to someone else.

Or, you could wait until you pass, and it can be transferred to the trust on a Form 5, eliminating the $200.

I had a brief with just me as trustees for years without problem and then ATF rejected it saying there needs to be more than one trustee for it to be accepted. Frustrated I put my wife's name on there and it went through.

I don't see any reason to put it in a trust now. They could change the rulings regarding trusts but can't really if it is in your name alone.

When I established my trust I included the wife. She has guns and a license. My major concern/worry was if she was not on the trust she technically has "access" to NFA items without my "authorization" as a trustee. If she went into the safe to get her gun she in theory has access to the NFA items. (I always think worst case scenario and fell its best when dealing with the Feds) Also there was the issue if something were to happen to me. She wouldn't be stuck with guns she had no power to keep or sell. I'm sure its not simple to sell of NFA registered items in the event of a death and you are not a part of the trust they belong too. I spend the money on the trust, I will most likely keep my next item within the trust for those reasons.
 
I’m the only one on my trust and I never had any issues before. My last stamp was a couple of years ago though
 
Can I print my own fingerprints on the supplied FD258s?
I thought my ID must be certified by the LEO who does my prints and then he must sign off on it?

Should I use my local PD as CLEO or should I use the AG Office?

Sounds incredibly fast. Frankly I hear a lot of things about FOrm 1's and most of them are rumors or straight BS.

I'm looking for somebody who has experienced either success or failure not rumors. I'm also looking for BUILDS not purchases. Thanks.

I received two eForm 1 approvals. My first one was 11 days, I filed it the first or second day eForms came back on line. My second was around 25 days, it was filed the day after my first approval. I tried for a third on 12/11/18 but it didn't clear before the shutdown. Many people received quick turnarounds on approvals early on but it was creeping out. Of course, the ATF is shutdown now and only approving Form 3 and MIL applications. If you Reddit you should follow /r/NFA, it's pretty boring at the moment but when approvals were happening there were a lot of timelines for approval offered, mine are there someplace. Its also good for NFA gun porn, if that's your thing man. To give you some peace of mind about your paper forms, I did two paper Form 1's in May and they were approved in 90 and 92 days, filed together oddly enough.
