Massachusetts Bill HD.4420 "An act to modernize gun Laws"

Wish you guys that are doing all of this posting were spending the time talking with your law makers.
At least some of us are. That's been the one unalloyed good thing about this thread. When the next load of crap comes around, I will try again to maintain the 'who's who' list of those legislatures inclined to stop and/or blunt whatever the bill is. I was aggregating that list both from what people posted here by way of responses from their legislcrestures, my own responses, and similar info gleaned from other fora.

I'm hoping/assuming (yeah, yeah, ..of you and me) a new thread named for the one or more new bills gets started as they happen.
 
Nice job Ware! Honestly, I think some of that text was lifted from the GOAL website, which is a major plus in my mind!
I think the more we can find other PDs willing to step up like Ware, the better. Maybe the pause we're in now can be used to make friends. I had some luck getting an unofficial 'yeah, that bill is pure crap' but no luck getting them to make a public statement. Yet.
 
Well, after the Democrat Governor of Arkansas actively ignored the Brown vs Board of Education ruling by blocking schools with the national guard, President Eisenhower activated the Arkansas NG and brought in the 101st Airborne to enforce the SCOTUS ruling.

I don’t see our current administration standing up for our system of government like that, unfortunately. Especially when it’s not just the states, but also the executive branch itself who is trying to ignore SCOTUS rulings.

Sent 35 to 40 emails....I think...I have lost count at this point....and I have been asking everyone that I run into these days if they are a gun owner and if so are they aware of the proposed 4420 bill. Surprisingly most of the gun owners were not aware of the bill in the first place .......but they are now. At this rate I will have to register as a lobbyist in order to be in compliance with the federal regulations covering lobbying.
 
In order to proactively address the state senate with regard to any retarded firearms policies they wish to pursue, who's the more important politician; Karen Spilka the sen president, or Cynthia the Stone Creemer, the majority leader?

I have tried to contact my State Representative 5 times.......so far......in order to respectfully explain my opposition to the proposed 4420 bill and any others that are written with the same intent to unfairly attack law-full gun owners. This is pretty much the response that I have received so far:

I think that the Majority Leader is the one who is expected to do the heavy lifting at the direction of the Senate President but in view of the fact that I have never, prior to now, made any attempt to try and influence any politicians on a specific piece of legislation this is all pretty much new to me.

This is the only public news about the Majority Leader that I have seen so far. Frankly in light of the fact that we are talking about legislators in the People's Democratic Socialist Republic I can't say that I am overly optimistic about getting a fair evaluation of the 2A point of view from these people.

STATE HOUSE, BOSTON, JULY 25, 2023…..As the House backs down from its plan to advance an omnibus gun reform package this summer, the Senate is now considering its own strategy to potentially produce a comprehensive bill or combine some of the many proposals awaiting a committee hearing.

“I know we in the Senate are going to be working on our own bill,” Senate Majority Leader Cindy Creem told the News Service on Tuesday. “We’re going to now be working on trying to find consensus in our body on a bill that we can put out. We’re looking to do our due diligence.”
 
Driving thru Middleboro and Halifax today I seen a couple lawn signs “STOP HD.4420”. They looked great, bold red, black and white signs. *Sorry no pics.

Anyone on here, where did you get them made?
Shooting Supply and some other places were indicating that they had them available to be picked up if you wanted one. I heard some people were requesting a donation to GOAL or another outfit for a sign.

Attorney Andrew Branca is indeed an excellent source of legal information oriented towards the subject of lethal force employed in a perceived self-defense situation. His book .....

Oliver Wendell Holmes Jr. once said, "This is a court of law, not of justice". In our eyes we may think that a self-defense shooting is pretty straight forward and discover to our undying regret that upon our arrival in court that is very much not how the legal apparatus views the situation and the shooter now faces potential incarceration and fiduciary ruin.

In 2005 I attended a GOAL class entitled The Art of Concealed Carry in MA. The legal discussion of the class was led by the late attorney Darius Arbabi who was at that time a practicing criminal defense attorney with wide ranging experience in the defense of self-defense shootings as they actually played out here in the Republic. He made a point of bringing to the classes' attention that if one had to defend themselves in a self-defense shooting situation the entry level legal cost would start at $50,000 if it really was a case of self-defense and if there were any doubts whatsoever that the shooter may have been at fault the entry level legal defense cost would start at $200,000 and increase from there. His point was that it really behooved one to have a clear understanding of just how the law would be interpreted by the courts in this day and age especially here in a very unfriendly Republic.

There is a mantra that I remind myself of whenever I leave the property carrying a concealed handgun:

A prudent and reasonable individual knowing what you knew at the time of the shooting has to believe that a threat of imminent and unavoidable death or grievous bodily injury existed and the person doing the threatening had the ability, opportunity and the jeopardy to bring that threat to fruition in order for the subsequent employment of lethal force to be considered in the legal realm as a justifiable self-defense shooting.

Attorney Branca's book delves into the specificity of what all these individual components of the legal definition of justifiable armed self-defense are and how the court system actually views them. I would strongly recommend the purchase and study of his book prior to any serious commitment to going about one's daily business while carrying concealed. I would also recommend attending the GOAL Concealed Carry class if you are able to do so.

Concealed carry believers are at a definite disadvantage here in the Republic. Self-education can go a long way to trying to even up the odds in our favor.

UPDATE ON HD 4420, AN ACT MODERNIZING FIREARMS LAWS:

After a series of “closed-door meetings”, the House has slithered away from its plan to smuggle the anti-gun Bill under our noses this summer, resetting their sights on the fall session and hoping that the concerns of their Constituents will fade away with the passing of time.
However, the Senate has now decreed that it is also “intending to do something” about gun control by taking matters into its own hands and crafting a SECOND potentially nefarious and unjust Bill.

Remain vigilant! We cannot allow partisan politics and corrupt bureaucracies to curb-stomp the liberties that generations before us fought so hard to preserve. As we’ve seen, our collective voices can bring about real change and compel the House and the Senate to prioritize the will of the Commonwealth over anything else.
Let us come together as a true Constitutional Republic and show our representatives, who are bound to uphold the rules established in that Constitution, that we will not rest until this nauseating Bill is annihilated before it is enacted into law.

While we recognize the importance of addressing gun violence and ensuring public safety, it is essential to do so without infringing upon the rights of law-abiding citizens. Instead of jeopardizing the Constitutional rights of responsible gun owners, we urge Congress to pursue solutions that target the root causes of violence, such as improving access to mental health services, reshaping and healing our societal infrastructure, and preventing repeat offenders from walking the streets with utter impunity.
Massachusetts is the proud birthplace of a united national resistance, and considering that those in power have no shame in publicly proclaiming their great wish for this Bill to become the model for every State in the Nation, the time to act is now.

Therefore, we encourage all Citizens of the Commonwealth who value their Constitutional rights to join us and persist in voicing their concerns to their elected representatives. Here are some suggestions on how you can proceed to make a difference:
1. Continue Contacting Your Representatives: Reach out to your Members of Congress via phone, email, or social media. Don’t relent! Express your concerns about the anti-gun bill and stress the urgency of addressing this critical issue. Personalized messages have a more significant impact, so share your personal experiences or thoughts on why this Bill troubles you.
2. Utilize Social Media: Leverage the power of social media to raise awareness and mobilize others who share your concerns. Use appropriate hashtags and encourage respectful discussions with friends and followers about joining the cause and the importance of protecting our Constitutional rights. Social media can be a powerful tool to raise awareness and generate support.
3. Encourage Others to Get Involved: Talk to your friends, family, colleagues, and neighbors about the impact of this issue and inspire them to make their voices heard. A collective effort is more likely to bring about meaningful change.

We firmly believe that safeguarding our communities and upholding our Constitutional Rights are not mutually exclusive goals. Frankly, I'd go with the legal brief that is being submitted to the Supreme Court over the rantings of the mindless fools pushing this crap.

I have noticed that whenever a politician is talking about the crime rate in their particular state their stock answer is almost always it's because of "a neighboring state which has lax gun laws". What they never seem to mention is that so called "Free State" usually has a lower crime rate as well. When I try to explain my opposition to gun bills such as the 4420 proposal, I point out that Chicago, L.A., New York City, Washington D.C. and Seattle all have strict laws restricting legal citizen ownership of firearms and that has not seemed to result in any noticeable reduction in their crime rate. Call me crazy....but maybe.......just maybe......if the entire focus was on the criminal, then perhaps the crime rates would decrease and the quality of life in those areas would increase. I know.....it's a silly idea but one can still dream of a better future for themselves and their loved ones.

Also important is the committee this turd ends up in, the ultimate goal would be to convince the committee to give it a "ought not to pass" designation and send it to study. Obviously a heavy lift to achieve that.

Here in the Republic, it is difficult to try to calmly explain our concerns about why we think 4420 and similar bills of this nature are not the answer to improving the quality of life for all citizens because we are having to try and overcome this stereotype:

I had never envisioned having to spend my retirement trying to fight for the preservation of what I sincerely believe is one of our most important Constitutional civil rights but here we are. If we as a group of decent law-abiding gun owners do not make the attempt.......no matter how much the odds of success are stacked against us........to fight for our rights then we will be cursed by the citizens sitting around future campfires wondering just what the hell happened only a few generations ago.

I try to keep my fractured sense of humor during the course of this unending struggle by thinking about things such as:
