California has restricted the sale of most firearms to anyone under 21. Plaintiffs challenged the bans on long guns and semiautomatic centerfire rifles under the Second Amendment. The district court declined to issue a preliminary injunction.

We hold that the district court did not abuse its discretion in declining to enjoin the requirement that young adults obtain a hunting license to purchase a long gun. But the district court erred in not enjoining an almost total ban on semiautomatic centerfire rifles. First, the Second Amendment protects the right of young adults to keep and bear arms, which includes the right to purchase them. The district court reasoned otherwise and held that the laws did not burden Second Amendment rights at all: that was legal error.

Second, the district court properly applied intermediate scrutiny to the long gun hunting license regulation and did not abuse its discretion in finding it likely to survive. But third, the district court erred by applying intermediate scrutiny, rather than strict scrutiny, to the semiautomatic centerfire rifle ban. And even under intermediate scrutiny, this ban likely violates the Second Amendment because it fails the "reasonable fit" test. Finally, the district court also abused its discretion in finding that Plaintiffs would not likely be irreparably harmed. We thus affirm the district court's denial of an injunction as to the long gun regulation, reverse its denial of an injunction as to the semiautomatic centerfire rifle ban, and remand for further proceedings consistent with this opinion.”

Every signal gun law in Cali should be tossed. Along with all the other states.

Is there an age limit on the 4th or the 5th. How about all the rest.

This is going En Banc faster than a fat guy charging into a Taco Bell restroom.

The second that panel was drawn, we could have predicted a 2-1 pro 2A decision.

A liberal judge will call for an en banc vote, dems have a 16-13 majority in the 9th so it will go en banc. Liberals have an advantage on en banc draw’s because of the 16-13 and the chief always being on the en banc and she’s a liberal. That POS Sidney Thomas if finally gone.

For those who don’t know, the 9th does a lot of en banc panels and it’s not the full slate of judges who hear the case, it’s a random drawing of 10 of the 28 judges plus the chief judge.

I've always been pretty perturbed by the whole thing. They reallt ought to pick a damn age and stick to it.

Vote at 18.

Drive at 16.

Buy a rifle at 18.

Buy a pistol at 21.

Drink at 21 (maybe smoke weed too depending on state?)..

Gamble at 18?

I want to say topless entertaining is ok at 18 but to be a real stripper they gotta be 21? (Some 19 year old from FL I picked up at a NH bar when I was in my 30s explained this to me, worked at topless places back home, had shot some meat porn too - she really was something else)..

Smoke butts at 18.

Vape at 21.

Join the service, die for your country at 18.

Get drunk at 15 and run over a police dog, potentially you are charged as an adult for manslaughter of a police officer. Because you know, you were obviously thinking as an adult at the time.

Brain development in areas related to emotional control and behavior in males is not complete until age 26. That doesn’t mean men gain self-control at 26 - only that things can drift until then due to hardware changes. The software can be alpha until age 40+ or reach release version 1.0 in late teens.

But as the article/comments note, with <1/4% of <21yr-old people committing violent crime, restricting guns for the 99-3/4%+ is ridiculous. Rifles? Not the issue in violent crime, so why even go there - AR15s, of course. If age demographics of violent perpetrators is the point, why not restrict males <50 years of age? Or go race, ethnicity, etc? Or Southerners?

Young white males become old white men - that’s why. We are the enemy…
