Orchestrating an ASW prosecution case to force the hand of the AG and collapse the system

I agree with your right to OC if you want, but if it was me I wouldn't be picking that hill to
die on.

You are assuming that if we pick enough fights that we will eventually win. I think that is a bad assumption.

No worries guys, I'll just keep quietly seething that cops can be ignorant of the laws, violate the rights of otherwise law-abiding citizenry, and get away with it. I'll be like that guy Milton in "Office Space" :)

Or maybe I'll just move to another state or even western MA, where they are less uptight about guns, until the uprising/apocalypse. Anyone have a cheap house for sale with some land that just happens to be 500 feet from any other dwelling and 150 feet from a road?

“The Law” is only somewhat relevant.

As long as Ma has a license scheme to “allow” you to buy, own or carry. You don’t have rights, you have a gov tolerated activity that they don’t like. But can not entirely get rid of. So it is tolerated, within their bounds of reason.

they can yank your license and impound your property due to “suitability”. Then even if what was being done was legal. The process of getting your property or rights back becomes the punishment. Few can afford the money and time to get their stuff back.

Bartley- Fox is a great example. Those w/o licenses are virtually exempt from laws.

So, why did GOAL post this like this was a big deal?

This all leads up to the new registration scheme.

How many gun owners are going to register these AR's when the system gets up and running?
I preemptively sent a list of all my weapons and serial numbers along with a count of all my magazines and ammo to the AG.

Just trying to get ahead of the rush.

Just keep in mind they don't need to "win" to destroy you.
Just break you.
Savings gone , house gone and in hock to your eyeballs in lawyer fees.
Martha Coakley was the master of it.
Delay , continuance ect. till your well ran dry.

How true, I hate lawfare and have never fought that fight. The process is the punishment. Only took a month to get my stuff back and it was exhausting.

I guess what I'm asking is what would happen if somebody does not register?

Well, if they are caught that is an easy crime to charge. That’s not open to interpretation, conflicting, and unclear like the entire ASF debate. Suggest reading H4885 in its entirety.

Section 121B.(a)(1) The department of criminal justice information services shall develop and maintain a real time electronic firearms registration system. All firearms possessed, manufactured or assembled in the commonwealth shall be registered in accordance with this section.

(e) Whoever fails to register a firearm in violation of subsection (a), or fails to report a transaction, loss or theft in violation of subsections (b) or (c) shall be punished as follows: (i) by a fine of not more than $1,000 for a first offense; (ii) by a fine of not more than $7,500 or imprisonment up to 6 months, or by both such fine and imprisonment, for a second offense; or (iii) by a fine of not more than $10,000 or imprisonment for not less than 1 year nor more than 5 years, or by both such fine and imprisonment, for a third or subsequent offense. Failure to report shall also be a cause for suspension or permanent revocation of a person’s license, card or permit.

And, whats going to happen if the state looks at LTC holders and their transaction history and all the guns they think you have.

I think that’s a big unknown. Could be nothing, or could be something. They’re going to populate the new database from the old system so instead of starting with clean “good” data, it’s going to be garbage from the start.

So, based on the reading of this, those of us that don't register will immediately be at "strike 3" as I imagine the State will take the stance that failure to register handgun #1 was the 1st offense, failure to register handgun #2 as the second offense, etc etc etc
