Shotgun and B&E in NH but he missed?

You can miss with just about any shotgun ammo, not just slugs. The spread
of shotgun pellets/shot at typical engagement distances isn't wide enough to
drastically improve the hit ratio of the projectiles. I'm guessing the homeowner
just had the shit scared out of him and possibly jerked the gun off target or the
target wasn't where the homeowner thought he was when he pulled the trigger.

I saw the story on the morning news as I was getting ready for work . They said that the cops confiscated the gun . They also said that the man should have called 911 .
Why did they take the gun ? Is it because he told the cops he shot at the intruder before he called the cops ?

They probably took the gun as evidence. If it was a rightful defensive shoot, then I think he'll get it back in short order, but if there's something else going on then perhaps not.
