I did some quick math.

There are 2092 separate offenses in Massachusetts.

Sorting by the term of penalty will take way more time than I have.

Since this is a PDF, you will need to convert it to an excel spreadsheet in order to sort by the penalty column.

So if you want to know how many crimes have a penalty of 1 year, this will tell you if you convert and sort.

Note the list appears TWICE in this PDF. Yes the person who drafted this was apparently not too bright and has one list with seemingly random order and then the same list in Alphabetical order by the title of the crime.

My math for the number above:

29 "crimes"a page

pages 2-74 +4 crimes on last page. So 72 pages * 29 crimes per page = 2088 + 4 crimes on the last page = 2092.

Also, I see many with H/C but no Prison. Whats the difference?

For example, prostitutes are all PP if caught? Also, 5 years for being a prostitute?

someone already sells their body for sex...and as if thats not punishment enough the the state tacs on lifelong felony status and prison time to ensure the same person will now have no options except prostitution.

That is for federal PP. What about Mass PP? Isn't the Deleo bill changing the Mass definition of a PP to be one year for state misdemeanors?

The key word here is...

(i) has ever, in a court of the commonwealth, been convicted or adjudicated a youthful offender or
delinquent child, both as defined in section 52 of chapter 119, for the commission of: (a) a felony; (b) a
misdemeanor punishable by imprisonment for more than 1 year;

The 2121 figure isn't accurate, and the numbers really doesn't matter.

What matters is does the punishment fit the crime.

Actually that number is correct. It is the total number of criminal offenses in Massachusetts. Jasons posted a list in the Deleo thread listing all the new offenses that will make you a PP in mass.

If you have sex for money you are a prostitute, but if you film it and get paid you are just making a porno.

There is one for blasphemy, but it's only a one year max sentence so blasphemers are OK.

On the other hand, if you write in a library book you're DQed for life.

The statement of an employee or agent of the library, eighteen years of age or older, that a person has violated the provisions of said section ninety-nine A and this section shall constitute probable cause for arrest by a law enforcement officer authorized to make an arrest in such jurisdiction. The activation of an electronic anti-theft device shall constitute probable cause for believing that a person has violated the provisions of this section.

It's the theoretical maximum, even if no jail time is given.

"Derive support from prostitution" is generally not a charge leveled at hos, but for pimps (or "business managers" if you want to be politically correct)

while some things are plain, any that contain "encouragement" is open to interpretation, i.e. you got to fight against the well funded state to argue your case. These are basically 1a infringements, because even if technically you are right, you will spend a tonne of money proving you are right, hence you already lost something. Best of luck trying to recover $$$ from the state as your attorney fees.

And even if you did get reimbursed, they'll just tax you more to get it back.
