Tranferring a Colt Model 1908 Vest Pocket from FL to MA with a C&R FFL

I am a new C&R FFL licensee. One of the reasons I got the license is a relative wants to gift me a Colt Model 1908 Vest Pocket he has in FL. Is there any problem with having him ship me the gun to my address in MA. Of course this gun is not on the MA gun roster but as a more than 50 year old gun (they were last produced in 1948) it should be OK to bring into the state as an antique.

I'm looking for advice on this and how to have him ship it. I have read that USPS will not ship handguns but UPS and FedEx will ship overnight only if it is declared as a gun but not labeled as such on the package.

Getting it shipped is going to be an issue so the easiest way to do it is to have him find a FFL there that will ship it to you as a FFL with a C&R

Even UPS and FedUp are giving licensed FFL's a ration of grief, I can only imagine the trouble they are giving C&R FFl's without a storefront or commercial address.

IIRC they are not taking shipments at the depots from non FFL's anymore, if you had a commercial account with jumping thru all the hoops to get approved as a gun shipper you could send a pre paid label and send it on your account

PPS the easiest way to get it is to fly down and get it, then declare it in checked luggage on the way back

I thought since I am not a Florida resident I can't legally take possession of the gun in Florida even as a C&R FFL.
Well the work around for that would be and I think you would actually be able to take possession of it in Florida but for the sake of conversation will say that your uncle is going to loan you the gun for legitimate sporting purposes which is a legal method to take a gun over state lines and then he decides that he wants to give you the gun after the fact now it is in Massachusetts your home state so you get a transferred to yourself. Just remember that when it legally becomes yours you have to file an EFA 10 within the allotted time which I believe is 7 Days one of the Massachusetts guys can chime in and correct me if I am wrong
 
PS you have to remember that Florida is now a constitutional carry state even for non-residents. You just can't open carry and you can't carry in a bar room and a couple of other little things like schools and post offices

Not true at all- you can intake a C&R handgun not otherwise prohibited from anywhere. That said some remotes may get cooties over it (because you're MA based) but there's nothing legally prohibiting it. That's the whole point of an FFL.
 
This is kind of a don’t ask don’t tell. I’ve received a few things from Florida. Just have your friend shop around until they find an FFL that will do it. It may come USPS, UPS…who knows. In the end you’ll receive it one way or another.
