I open carried in Boston today

I saw a guy today open carrying a knife.

He was talking to himself and waving it around in loopy circles, then he kissed it and put it in his pack.

It was so bizarre I did call the police.

In all seriousness, last year in Newton, I saw a guy walking down the street very angrily yelling to himself out loud, with a very disturbing expression of pure rage. I saw him again a few days later doing the same thing. A couple days later he killed three people in their home.

I'm now a little more inclined to report people who look insane and particularly waving weapons on the street. This other guy I saw
wasn't yelling, but he was talking to himself in a very engaged way, and with the looping swipes with a blade, and the kissing it, you sometimes
need to listen to your gut, when someone is acting threatening.

I remember that story. The murders were absolutely brutal and he was found incompetent to stand trial and was put in a hospital.
 
Yeah and apparently his family kept trying to get him hospitalized but there is no place that would keep him while he was
obviously psychotic.
I’m sure if he had been taken for 72 hour observation they would have done a walletectomy and diagnosed him with an insurance deficiency.
 
Resurrecting this because I open carried a bunch a couple years ago. I'll share details if interested, but this ain't my thread.

Long story short, the cops unlawfully took both my firearm and LTC and held them for a month. I was not cited or charged with any wrongdoing. Took a lawyer's nasty letter and him visiting the CoP to "discuss" things to get my stuff back. This was generously paid for by a MA 2A org.

I fully support exercising open carry rights, which we supposedly have, but in this much smaller town (and others nearby like it) the cops will not only mess with you but illegally steal your stuff. I'd sue them for unlawful search & seizure but I'm too poor to afford a lawyer.

Welcome to NES. I know some forums get hung up on this, but NES doesn't get precious about who "owns" a thread. By all means, post your experiences; a lot of us would be very interested.

The fact that you almost certainly could not obtain contingency fee counsel for such a suit tells you what your chances of prevailing and collecting significnat damages are.

If you want to go full varsity on open carry, register an AK as an SBR; convert it; and carry openly (preferably on a sling). A SBR if a "firearm" under MGL, not a rifle or shotgun and is covered by a LTC. I doubt even the Simkin precedent would help much.

Here's another example of pushing the legal limits:

In FL, apparently it's legal to open carry on public ground without a gun permit while going to/from fishing/hunting/or camping (still need fishing/hunting permits).

This dude properly open carries an AR pistol on Clearwater public beach while holding a fishing pole on the way to the fishing docks. Long story short: he gets off scot-free and even loads a 30rd mag in and RACKS IT IN FRONT OF A CROWD OF POLICE [rofl] [rofl] [crying] 42 mins long but its pretty entertaining to watch.

Anyway there's not much more to share, and I'm a bit afraid of too many details. I was looking around for a lawyer at one point. One of the gun store guys I really like in the area had a lead for me, but said something curious I won't forget. He said he wouldn't give me the name of the lawyer he knew because once the cops got wind of the case, they would certainly be vengeful and take it out on me and my family. This is no ordinary gun store clerk either, he trains police in gun tactics. He's probably already on this forum (hello sir).

I once thought the cops were on our side, this was one of the many experiences I've had that prove the exact opposite. They not only do not know the laws, but flagrantly ignore them and then look to the law to justify their overreach and abuse of authority.

But that day, the cop said to me, "We don't do that in this town," regarding open carry. There is no such bylaw here, of course. The only thing they had the power to do was check my license, which I had with me.

EXTREMELY COMMON. Cops and the state in general, tend to target people who assert their rights far more than people who just submit. After all, their whole schtick deals with power, control, and authority. Anyone who challenges that, is a threat. People who "just comply" are exactly what they want.

This applies to EVERYTHING. Not just guns. But literally anything you do or don't do, say or don't say. ANYTHING. All that's required, is somebody from the state doesn't like either it or you.

I've seen it a thousand times. Person does nothing wrong and has their rights violated. The person seeks redress, so the state doubles down. Where maybe the state just violated their rights by falsely arresting them and then letting them go, now all of a sudden you get a criminal summons for say...resisting arrest. All because you spoke out against the false arrest. They get to both punish you and it works as a defense against their false arrest. Again, it literally happens every single day.

I completely understand why people choose not to pursue legal action against the state even when the state has obviously and clearly committed crimes against them. We can only fight them as much as our wallets can afford, and ultimately, the only people who are punished are the taxpayers who pay the settlements or lawsuit damages. The state has unlimited resources and are retributive.

Or, did I have a license and it was just not in my possession? Was I going to get my stuff back, and if so, how? The CoP demanded a "meeting" which people advised me NOT to attend, nor should I have had to.

Did you attend it? And how did that go?
 
For a meeting with a lawyer on one side and a CoP on the other and me in the middle, it went decently well. I got my stuff back. FWIW the lawyer is apparently a fairly famous 2A one in MA, and he's a bit brusque and surly, but I had a chance to talk with him personally and ended up liking him a lot.

Worth noting that our normal CoP was under FBI investigation at the time for certain crimes... so this wasn't our normal one. I was surprised at his lack of respect for citizens and his disregard for 2A rights, but then that always shocks me coming from police.

There's no need to swear at the police while you're asserting your rights. This is where I disagree with this dude.

Also, there is absolutely no need to carry with a round in the chamber when on a public beach. That's just stupidity imo.
