NORTHAMPTON, Mass. (WGGB/WSHM) - A Northampton man pleaded guilty Tuesday to multiple charges after being accused of firing a weapon into his neighbors' home last year.

We’re told the 11 charges he plead guilty to included:

  • Armed Assault with Intent to Murder (4 Counts)
  • Unlawful Possession of a Large-Capacity Rifle
  • Unlawful Possession of a Feeding Device for Large-Capacity Rifle
  • Unlawful Possession of Ammunition Without a License
  • Discharging a Firearm Within 500 Feet of a Building
  • Unlawful Possession of a Large-Capacity Rifle
  • Improper Storage of a Large Capacity Rifle
  • Malicious Destruction of Property Over $1,200
...

The DA’s Office said, “As part of an agreed-upon change of plea recommendation, the Commonwealth dropped the charges of possession of a firearm without a license and cruelty to animals. No animals were hurt in the incident.”
 
IMO, there's not a lot to see here. Martinelli had already confessed to the police, telling them that his dog told him to do it. So the only reasonable choices for the defense were a plea or an insanity defense, and there wasn't much to work with.
  • Depending on exactly what he confessed, the defense might have been able to reduce the "Intent to Murder" charge down to ADW or reckless conduct.
  • Cruelty to animals could be fought on the intent requirement, or whether scaring them constituted cruelty.
  • Carrying a firearm without a license requires the state to prove it was outside of his residence. The definition of residence for this statute appears to include “all areas in and around a defendant’s property, including outside areas, over which defendant retains exclusive control.”
But once a guilty plea to "Intent to Murder" was agreed on, there's no reason to quibble about the other charges. The exact laundry list would have no effect on Martinelli's future life, either in or after prison.
 

The suspect identified as, 22-year-old Jean Rodriguez-Claudio of Springfield, was arrested and allegedly had oxycodone that officers seized. During a search inside the vehicle officers recovered the following:

  • Zastava rifle loaded with 31 rounds of ammunition
  • A loaded firearm with 19 rounds of ammunition that had a sear-selector switch, which makes it a fully automatic machine gun
  • A loaded firearm with 13 rounds of ammunition
  • Additional loose rifle ammunition
Rodriguez-Claudio is charged with the following:

  • Possession of a Machine Gun
  • Possession of a Loaded Machine Gun
  • Carrying a Firearm without a License (Three Counts)
  • Carrying a Loaded Large Capacity Firearm on a Public Way (Three Counts)
  • Unlicensed Possession of an Assault Weapon
  • Possession of a Large Capacity Firearm during the Commission of a Felony (Three Counts)
  • Improper Storage of a Large Capacity Firearm (Three Counts)
  • Possession of Ammunition without an FID Card
  • Receiving Stolen Property Less than $1200
  • Receiving a Stolen Motor Vehicle
  • Possession with the Intent to Distribute a Class B Drug
  • Possession with the Intent to Distribute a Class D Drug
As the vehicle was being prepared to be towed, a 16-year-old boy approached the officer and allegedly told them that the firearms were his. The teenager was arrested however, due to his age no additional information was disclosed by police.

IMHO, (the last paragraph) was very generous of the Commonwealth...
