NY Senate passes 'landmark' gun control laws

Very sad day in NYS but we have to stay strong and continue to support each other. I'm very disappointed in the lack of national support in NY. SCOPE was in the fight but they are just too small.

This will be challenged in court, but it will take a while to work through the system.

I'm not a big fan of the NRA, but I suspect they're silent because they want to see what King O will do. Then they will plan a counter attack.

i also am asking "where is the NRA?" these gun owners in NY just got straight up ****ED and no one was there for them. NOT COOL.

Anyway, laws like this make me happy. The more retarded shit they throw at us in law, the more we can push back in court and have the courts figure it out for good. Thats how all this is going to end long term. The faster it gets over with, the better. 7 is a fantastic number. not many magazines are made in that size, therefore are not common use. Should be somewhat decent to sue the state with. 7 is going to be very hard to defend on a constitutional basis, where as 10 is easier in my opinion.


Looks like I'll have to be donating to whoever decides to sue NY.
 
For certain this will be challenged in court. What are their plans for compensating people for having to either dispose or their property or face criminal prosecution? What are people supposed to do from out of state who want to move into NY with "banned" items? What about traveling into the state for firearm matches with now illegal guns?

It also affirms my belief that Northeast Republicans are basically equivalent to left wing democrats in the South.

So not only do people in NY now have to register their guns, there is a recertification period each 5 years so they can continue to track those that possess any guns.

"The deal calls for gun owners to “recertify” with the state police every five years that the original information on their gun license is still valid."

DHS will face little resistance in NY now me thinks. Those with gun licenses please form a line to the right for internment.

It also appears those in NY can keep their high cap mags but cannot load more than 7 rounds in each:

"While the size of ammunition magazines sold in New York would be reduced from 10 to seven bullets, owners who now have the larger-capacity magazines can keep them; but the deal would ban them from placing more than seven rounds in each."

I agree on the lawsuit point. However, it's a defacto ban on most semi-auto handguns. The only pistols that have 7 round mags available are small carry guns. That's it.

The Heller decision refers back to Miller and speaks to guns in common use. I hope better legal minds than mine can determine that this NY law is a violation of that.

This shit is going to get hulk smashed in court. I would be very surprised if a confiscation with a grace period is found constitutional. the slippery slope on that is laughably endless. You'd have to be an anti with an obvious agenda to support such things. I doubt it will hold up in SCOTUS because once they say its ok to take X, its ok to take Y and Z later on when those are also deemed evil and scary.

This is just the type of law I was waiting to see get ripped apart by the higher court systems. good for them!

That is not my understanding. If you own a mag of greater than 10 round capacity, you have 1 year to sell it out of state or turn it into the police. 10 round mags are grandfathered but can only be loaded to 7 rounds (WTF comes up with this stuff?).

We should all care. New York is not just NYC! I grew up in upstate Albany area and there are tons of rural areas and good country folk who love to shoot and have fun. New York State should separate from NYC, I have thought this for years.
Their fight is our fight.
 
The bill hasn't passed yet. Right now there's probably at least ONE guy sitting in his living room, full battle rattle and ready to go, just ****ing waiting until tomorrow.

This is hands down the most extreme gun control legislation this country has ever seen, and in this economy there are probably a lot of pissed off Americans with little or nothing to lose.

I think it has been mentioned before here, that firearm manufacturers that have contracts with the state of NY should get together and not renew them with the state. Let the state figure out how to replenish or repair their stuff, if the state is going to infringe on the citizens like that. Take the Ronnie Barrett approach to the next level.

I think until the bill is actually posted for review, the concrete provisions will remain unknown. I also suspect the bill will be posted for review after it is signed into law. That by itself should outrage all new yorkers. Guess we can now refer to New York as a true socialist state and even upstate NY'ers can't rebut that.

There were probably squishy votes the pro gun side could've flipped given the time to make it clear what the electoral consequences would be. Cuomo knew this, and that's why he bypassed the usually required 3 day public comment period. One source said that the Senators were only given 3 minutes to read the bill before the vote.
