Shootings Raise Questions About Self-Defense

Pennsylvania state law says you can protect yourself with a gun if you are placed in danger of death or serious injury.

But after two shootings this weekend involving self-defense, one person remains free while another faces charges.

Terrance Triplet shot and killed an intruder in his Esplen home Sunday and is not expected to face charges.

Eraldo Iannitelli, from Smith Township, Washington County, was charged with attempted homicide, reckless endangerment and aggravated assault after he allegedly shot a 16-year-old who is accused of hitting him with a baseball bat and robbing him.

In this case, the suspect was allegedly shot in the back, which could eliminate the threat or perceived danger required by law.

Meantime, Pittsburgh Police say they plan to meet with District Attorney Stephen Zappala Tuesday on the Esplen case.

IMO if you attempt to murder someone and run away you deserve to die.
 
hard to say.

past case and evidence would say that he was no longer in danger based on the fact that he shot the attacker in the back.

However, he was attacked with a bat, that can be deadly...

in the split second it took him to draw his gun and fire, could the kid hve turned around, yeah... and in the "heat of the moment", he still could have felt treatened with serious harm or death.

IMO, 1 less shitbag on the streets... but yeah, he will likely face a jury on that one. Not that I agree with it, but if you shoot someone in self defense, make sure it is in the front of their body.
 
How do you know the BG isn't going to turn around and go at you again?...unless he's already in the next yard.

They also would've wanted you to shoot the bat out of his hand, you know, like on TV.
 
It's hard enough to hit a vital area on a moving person, much less their hand. If you insist on shooting the bat out of the assailant's hand, the best way is first to put them out on the ground, then aim carefully at their stationary hand, being careful to avoid ricochets. Of course, this approach is not without it's own set of possible legal and public relations repercussions. [wink]
