SJC decision in frisking case is right on target

Michele McPhee of the Boston Herald got it right and so did the SJC in a recent ruling in favor of Boston Police in a conviction of Michael DePeiza of Mattapan.

Unfortunately, "Boston police arrested 723 people on firearms-related charges. Yet the Suffolk County District Attorney’s vaunted gun court only prosecuted 295 cases - leaving it unclear what happened to the majority of gun busts the BPD processed that year."

"Of those cases prosecuted, 170 gun-toting thugs were convicted; another 20 were acquitted, 34 are still in the system; and 11 co-defendants took responsibility for the gun. Three other weapons were non-operational because the guns did not work; five cases got tossed because the arresting officer did not show up in court."

"Three other cases were dismissed because the defendant was murdered and one was tossed because the defendant was mentally ill."

"Most appalling, 35 gun suspects were released back into society because a judge ruled that the police had no probable cause to stop the suspect or the charges were dismissed - even after Boston police recovered a weapon from that very suspect."

Are we serious about fighting crime and taking illegal guns off the street - or aren't we?

For those who would critize this position as lawful gun owners - fear not. Produce your LTC when asked by Boston Police and there's no issue since you're in lawful possession.
