My father is 77 and in poor health. He owns about 5 hand guns, one rifle and one shotgun.

As time allows, is it simpler for him to just transfer me his firearms using EFA10 form? If we did that, he would still want to keep them on his property. Or, do I wait for that fateful day to then take ownership of his firearms?

Right now no guns are willed to me because they were all purchased after his will was created.

Any advice is appreciated.

Update the will - can usually be done simply for small stuff like this.
 
As above. And totally not a lawyer so I would defer to them or someone like Len 2A to respond, but, it seems to me yes having him write into the will "all my guns go to Ashdump" would be the easiest way to go. Just my 02, YMMV

I would identify each firearm and their intended recipient.

If you transfer them now but leave them in your fathers possession you will run afoul of the loaning a firearm provisions in the new law if you care about such things.
 
Great question. This is something all of us are going to face, from one side or the other.

IANAL, but my curiosity involves the idea that there are six firearms and your dad is only supposed to do four in a year. Not that (I'm sure) he or you cares all that much under the circumstances, but for the sake of having "good info" here, I wonder whether that's a problem if he lives long enough for the State to notice.

Again, I'm asking purely out of curiosity. I hope it's something you and he won't have to worry about for many years to come, OP.

408 purchases, sales, rentals, leases, loans or other transfers shall be reported to the electronic
409 firearms registration system. All firearm transactions shall be reported by all parties to the
410 transaction via the electronic firearms registration system within 7 days of the sale, rental, lease,
411 loan or other transfer; provided, however, that no report shall be required for a loan of a firearm
412 to a duly licensed or exempted person for a period of less than 7 days.
 
Piggyback NES for an opinion: when I reach ripe old age, if I want to take a sidearm with me and some loaded mags, for the perhaps violet encounter in the underworld, or maybe just sentimentality, should I take a nice piece, such as an HK P7, my fav carry piece, or any run of the mill Tupperware pistol (no RDS cuz battery life, right)? And while I don’t give a sh*t about MA laws at that point any more, certainly I won’t have to renew my LTC… What, if any, laws should my heirs worry about?

Open a trust asap, then no need to need to fa10
 
If he’s not shooting anymore, there’s no reason not to give them to you now. Do four before Dec. 31, then the rest after Jan. 1st.

That avoids all the will/inheritance stuff entirely. (Assuming he’ll live that long. Not sure what “not in great health” means)

It won’t be that long in the big picture until all possessed guns will need to be registered, so there’s not a lot of opportunity to have an off-books gun.

Or just take them and never tell anyone, if that’s your groove.
