If its considerd a flare gun it should be completly legal. I have a 12ga marine flare gun that I have kept in my car as a anti-car jacking thing for years now. the fact that it mounts onto a AR SHOULDNT make a difernce. I would think the only sticking point is if it can 'also' be considered a 'grenade launcher'. I would expect it has more to do with how its marketed then anything else?????

Well 40mm are actually grenade launchers and the 37mm are used for flares and or the shotgun! Lets not forget this story not so long ago.
