Oregon Case Ruled Against The State Board of Higher Education

While this decision only applies in Oregon, the laws are similar in Maine and the same out come could take place. Like Oregon, only the Maine Legislature can regulate firearms. Like the University of Oregon, the University of Maine system also has rules against CCW even with a permit. Like Oregon, if a student is found to be carrying on campus, they cannot be arrested but can be suspended. If a similar case were to be filed in Maine, the same outcome might occur. The same principle could also apply to the Baxter State Park Authority and their ban against CCW in their park.

"The court ruled that while the State Board of Higher Education has authority to control and manage its property and to enact administrative rules, it cannot override a state law that says only the Legislature can regulate the use, sale and possession of firearms. "
