Question on section 12a pertaining to LTC app

Hi, I am new here and I am looking for information on submitting my LTC application. About 15 years ago I went to the hospital after a family members sudden death. When I was there the ER doctor did a section 12a on me to keep me at the hospital. I was released about 24 hours later. I have received information that a section 12a is not a disqualifier but may be used to deny me based on suitability. So my question is if the Department of mental health can only disclose the prohibitor then how would this information be received by the police chief and FRB in a background check. I was never admitted to a department of mental health facility or even a general hospital's mental health unit I only remained a ER patient. I do have my med records and there is a pink sheet in my records but the form is only signed and dated my identifying information and questions one through three are not filled out by the attending doctor. The document is completely blank other than the signature and date from the MD. So as far as question 12 goes on the LTC application how do I answer. Also if I can answer question 12 as No do I even have to disclose this information on the application. I'm just trying to figure out if its not a prohibitor how the licensing authority will obtain this information?

But I did email attorney Guida and he responded back to me by saying that a section 12a is not a disqualifier or a prohibitor. But he did not elaborate on how this information would be disseminated to the licensing authority even though it is not a prohibitor. So I was just hoping to get some advice from other people in this community.

All we do is speculate. It won't help. Attorney Guida is a great lawyer and it would benefit you to pay him for an hour of his time to further answer your questions

Yes I plan on setting up a appointment with him. Like I said I was just looking for any information anyone on this forum had on the subject. Because I have read pretty much every pass thread on this forum and some people say that it will come up on a background check and others say that it won't. Attorney Guida didn't necessarily say it would or wouldn't come up on a background check he just said it's not a disqualifier.
 
Jason and I have discussed a decision in which a district court judge found that any hospital stay pursuant to section 12 is a commitment.
Ok thanks for the information. But he told me that this would not be an automatic disqualifier. He said that it will go against my suitability. So I guess my question is under Massachusetts law does this disqualify me automatically and if it doesn't how does the licensing authority become informed about this information. When it comes to this situation it is very confusing because I have gotten multiple different answers from people.

as suggested, @nstassel is your man. he helped me significantly, Guida wouldn't speak to me if I did come in for a consultation, Neil got right back to me and settled my nerves at least.

This… The city or town you are applying in may be a factor as well. Do not post it here though. Better discussed in your appointment.
 
You should contact one of the attorneys recommended on this site. I had a good experience with Jason Guida for a license application.
