However, to the state, they are codifying the Attorney General’s 2016 Enforcement Notice

So if they are codifying the 2016 AG Notice into law, wouldn't that infer that the 2016 AG Notice wasn't a law? Did they just admit it wasn't a law?
Are they now applying a law retroactively that wasn't a law before?

I think their position is that all post-94 ARs had previously been illegal, but under the new law they're generously making pre-16 ARs legal.

Well, the new law codified the 2016 date so it doesn't seem to matter much. It doesn't codify her entire edict, just select parts of it. The whole situation is ridiculous, and the language of the current law needs to be able to be read, understood and applied on its own, without going back to what used to be (as GOAL notes).

I know it sounds like a weird thing to admit, but I really do want to see them try to prosecute any aspect of this. Any appellate court would have a field day with this pile of shit. Just an absolute legislative debacle, wrapped up in an anti-Bruen temper tantrum.

I'm kinda fine with this law, actually. All it does is weaken the state's government. That's a win, though it may take awhile to bear fruit.

BEFORE 7/20/2016 is interesting since the press conference was 7/20/2016 and shops worked to sell out their inventory on that day. There are a lot of ON 7/20/2016 guns out there.

I sure hope there is a lawsuit ready to go. This "interpretation" of the new law is completely inconsistent with what is written and goes to codify a press conference that when litigated previously was deemed "no harm, free speech".

Here's an admission by the AGO that those of us who bought (unregistered) lowers prior to 7/20/16 but never built up the gun are free to build them up and register them, just keep paperwork proving that you possessed them (and the Email attachment below) along with the eFA-10 after you built it.

NOTE: The original query was if the AG was causing the ATF to hold back on approving NFA forms to build ARs in SBS configuration. The first sentence implies this but the last sentence clarifies that anyone can build out their previously owned lowers.

It’s a hard position to take that rifles built on pre 7/20 AR receivers are unlawful.

This is going to create an absolute cluster fk if GOAL’s points are the final version. It is not consistent with the law as written and not consistent with prior AG guidance either.

I’m still scratching my head how post 7/20 lowers are unlawful. 10 years of dealer audits and no one was pinched for this?
