Hopefully his statement to the police didn’t handcuff his lawyer too much.
Since I am mostly taking a WAG at what actually happened, who knows how damaging the statement was. I am surprised the decedent's ID hadn't been revealed yet. I bet there is a history of violent conduct.
 
From what I have seen and read, when a police officer is involved in a shooting he is transported to a hospital for an "evaluation" due to the stress. I wonder if that would be a good move by a non police officer who is involved in a shooting?

That would at least give someone some time to calm down and not blurt out something that may be used against him.

I would never advise anyone to "fake" anything. It's very likely that a stress inducing event is going to cause stress inducing symptoms. I also wonder that if the paramedics or hospital give pain medication such as Fentanyl or an anxiolytic such as Versed or Ativan if the patient would not be able to fully understand the Miranda waiver or give coherent answers to the police.

You shouldn't need to "fake" anything. Just clearly state in no uncertain terms that you are not feeling well and request to be taken to the nearest hospital. It's up to the hospital staff to make the determination what is medically wrong. Not the first responders. During the time in the hospital, don't say shite about the incident other than to request your lawyer.

Great Point and Great advice!
Since none of us are hit men or Professional Killers if you shoot someone in self-defense you should have an "adverse" reaction to the incident and need time to calm down and regroup.

I’m assuming he’s very well known to the Worcester and surrounding PD.
 
Based on FB comments from people who were there, the victim was a black guy named John (masslive supposedly IDed him but I can't find it). His gf and kid were in the car. He approached the guy's car but didn't actually break the window, the guy shot him through the closed window, the shooter gave the victim CPR, and the gas station cameras weren't working.

The victim, identified in court records as 31-year-old John Smith, was taken to an area hospital, where he was pronounced dead.

I wonder if that's his actual name and not a John Doe equivalent.

Imminence test seems hard to meet without the window broken first. There's no way this wasn't going to court. We'll see what happens, I guess.
 
I watch "The First 48" and one of the first thing the detectives do is start looking for cameras. It's amazing how many of those systems are inoperative for any number of reasons.

Oh, the second thing they do is start looking on the victim's and potential suspects social media pages. It's amazing how much incriminating stuff people put on FB and other sites.

It's very likely that they do. Also possible that nobody actually maintains the system.

Unfortunately I have to deal with security cams pretty regularly. Its extremely frustrating because they are often down in addition to built in blind spots and general poor quality. More often than not, its pretty much a waste of time combing through the footage. It doesnt surprise me that there is no footage in this case. Somewhere like Vegas where casinos have people whose entire job is to maintain the camera systems? Yeah, Id expect them to be working, but a convenience store in Worcester or a rinky dink apartment complex somewhere theyre probably down as often as they are up.

I havent seen TF48 for years but I remember being a little surprised at how often the entire case hinges on whether the perp talks or not. If the guy kept his mouth shut, half the time the detectives were like "Welp...".

Im a fan of first 48 too, good show. Most of those dead are less than stellar citizens but quite a few are completely innocent people who were killed by a dirtbag.

Home cams, small businesses, etc A LOT don’t have working systems or parts of the system are not working. When you get into larger gas station chains, Home Depot, lowes, Walmart, etc those systems are almost always working but often the distances are too far in exterior cams to see detail beyond the general incident.

I love the wanttabes who post pics of themselves with guns which are ID’d as the likely murder weapon. Even before FB, instagram, etc is cell phone location data and text messages. The shooters always have their phones and subpoenaed phone records put them feet from the crime scene at the time of the shooting. In the interviews the perps always put themselves across town so the cell data shows their a liar about that and kills their credibility on all of it.
 

I’d bet at inner city non chain owed gas station, convenience stores, small business, etc at least 1/2 of the systems are not working at all or have a number of cams not working. Some may have working showing live video but not recording too. A lot of business don’t make much profit in so so areas so they look to save money any way they can
 
Have you ever noticed how dangerous the QT stations in Tulsa are? I joke that every homicide in Tulsa somehow involves a QT. Whether it's where the dirtbag goes to try to get money out of the victims bank, the victim bought something just before he was murdered, or even someone bought something at the QT that ends up putting them at the scene.

A friend of mine was a lawyer for over 40 years. He did criminal, civil, expert witness, and started out fresh out of law school working for the US Attorney's office in Denver.

He said of all of the reality TV shows, "The First 48" was by far the only one that was realistic.

He was a big fan of STFU when the police want to talk with you.
