It’s been a while since I have done a form 1. When you register on the states portal system it will not allow for a rifle to be "processed" without the rifle having a 16" barrel.

Any insight?

I had just dug out my old paperwork and the portal used to let you register a rifle under 16”. Now no longer seems to be the case.

I tried, oh well.

Yup. It used to allow it, but they changed it a few years ago.

I wonder what is worse not registering or lying on the registration.

(I’m not faulting you) I’m just pointing out both are technically wrong. The flaws of politics is that allow the people to make the rules that know nothing about the industries that they try to regulate
 
Really don't want to hear a story about an ATF seizure. Sounds like you want to FA10 an SBR build. No shortage of knowledgeable SBR folk out there. Give them some time to respond and maybe PM them. MGL140 Section 121 definition of a firearm. GaryZ had an idea.

You are not lying. The state mislabeled "firearms" as "handguns" on MIRCS. MA law defines rifles, shotguns, machine guns and firearms (current law). All guns that are not rifles (16" or greater barrel), shotguns (18" or greater barrel, shoots shot), or machine guns (goes rat-a-tat-a-tat) are called firearms under MA law. So all handguns, SBSs, SBRs, AOWs and "others" as defined under FEDERAL law, are firearms under MA law and get recorded in MIRCS as "handguns".

It’s not an ATF issue (if you have for approved from 1), it’s a Massachusetts issue.

So to FA-10 a SBR, do is as a pistol?
 
It's your issue. Take 1/1000th of the cash you would need for bail and give it to a firearms attorney. Please.
I’m not funding a legal battle to fix the states broken website. I don’t have that coin.

I’m in compliance with the ATF, I have documentation of my previous sbr registration at sub 16” barrel and proof of me attempting to register this new one. I tried the system won’t let me. I’m not intentionally violating federal laws just to appease the state’s inaccurate website.

I will sleep the same as I do any other night tonight.
 
You went public with this, you submitted paperwork to the ATF, you got the best advice people could give. I can't help you. Nighty night.
 
The woman who runs the registration portal, Mikayla, told me there is an error in the software (where you can’t register its actual sbr length. She said the thing to do is register it as a 16” rifle.

EDIT: I just reviewed my conversation with her. She said that because of the sbr barrel length, to register it as a pistol. I suppose either would work.
 
If you have a 16" upper slap it on and tell MA about it while you wait for form 1 approval. There's no obligation to notify anyone when you change uppers. Assuming you have another upper this is pretty bulletproof. Maybe borrow someone else's upper for 2 minutes at the range?

Or do it as a handgun since that *should* say firearms ...although "should say" is not much of a legal argument. Or do it as a rifle and put in the lowest allowable number and claim you did your best?
