Cam Edwards was on The Reload Podcast discussing that Red Flag bill. Apparently it has many of the attributes Kopel suggested were missing from most such laws, although it’s still ex parte. It provides for a mental health evaluation, a public defender, mental health treatment, etc.
Many such bills started that way and got stripped down to just gun seizure laws by amendments. A Red Flag law with proper civil protections and mental health services is unaffordable and legislatures know it.
NY State Police have run out of resources just to to track and store seized guns and want $10s of Millions more funding - and they provide no public defender or mental health services.
A study of CA Red Flag subjects found Blacks overrepresented in the GVPOs (Gun Violence Protection Order) served at 10.3% (population 5.7%) and Blacks were more unwilling to initiate an GVPO than other races (35% unwilling vs 22%).seems like a lot of work when just playing into statistics like race and political party affiliation are staggeringly good predictors of criminality
