GOAL Takes on Third Suitability Case
Cox v. Lebedevitch
At the end of the 2022 Massachusetts legislative session, Chairman Day hid an amendment in a technology bill to "codify" suitability. This action was his first attack on the Bruen decision that ruled such licensing practices. More recently, three separate Massachusetts District Courts have ruled against licensing officers that still use this unconstitutional tactic to deny civil rights. In each case, the local authority has appealed the decision and GOAL is backing the cases.
The most recent case:
In late October, Boston Municipal Court Judge Richard Sinnott cited the Bruen decision in an opinion that ordered the Boston Police Department to renew Mr. Jordan Lebedevitch’s License to Carry. Lebedevitch was denied his license based on his suitability due to an unresolved personal matter.
After reviewing Attorney Jason Guida’s pleadings, the judge agreed that Mr. Lebedevitch should get his LTC back based on the fact that the use of suitability ignores a clear ruling from the Supreme Court – “the suitability standard is [the same as] ‘may issue’ discretion, which Bruen deemed unconstitutional in 2022.” - The City of Boston is appealing that ruling.
