Well, when the Legislature gives you a big pile of crap and 60 (oh, 40) days to get all of the systems in place for it, you're sorta F'd. An "official" statement that you can't even begin to enforce this at this time is better than getting sued into oblivion if you stop ALL sales b/c you can't implement anything.

Making this a 6/1/25 or 1/1/27 start date would have given them time to figure s-word out.

Maura sure does know how to sell Firearms!

I got fired because peoples feelings got hurt you can’t say ******, baby and whore of Babylon and the same sentence.. and not expect me to shake my head.. you also can’t go around call people faggots and they report me to HR. Then I can out somebody for being gay because I’m not a dick. It’s f***ing really complicated. I’ll have to work on my pronouns

So I suspect that the legal theory here is that the secretary of EOPSS has now amended the roster and added ALL long guns that are "not otherwise prohibited in Massachusetts"

This is within their authority under the new law. I doubt this authority survives legal scrutiny especially post SCOTUS removal of Chevron, but what do I know.

So while this was done poorly, is utter crap, and every other negative turn of phrase you can come up with... It potentially is within the authority of the Secretary of EOPSS to make such a declaration to add everything to the long gun roster.

She can say whatever she wants.
But she didn't ban anything.

If she wants to say she "banned" anything, then she should also explain why she didn't prosecuted anyone or shut down any FFL.

All I said was she put out a notice in 2016 stating all ar15 were copies and duplicates and no longer allowed to be sold. (Banned)

Yesterday, she put out a notice stating dealers can sell all guns off the approved roster list.

If she believes her word is gospel, than glock are allowed to be sold now because of her notice.

If she insistents that glocks still can not be sold, then she proved that her notices were BS all by herself.

That was it.

Do not conflate delegation with deference. The majority opinion in Loper acknowledges that the legislature remains permitted to delegate interpretive authority to agencies via statute, which is what is being done here, or so I claim.

And the part about “approved” handguns. Are Glocks for sale… or are we treating this as a typo almost as if someone had said they were really good friends with school shooters?

Separate authorities and separate statutes. The prohibition against Glock comes from M.G.L. c. 93A, which protects consumers from unfrair business practices, including those involving firearms and is delegated to the AG not the EOPSS.

Mr. Crackpot, does this mean there is now a rifle "roster" that still excludes ALL semi auto rifles and shotguns? HTF could they possible figure that out? They know nothing of firearms.
 
That’s why it was an emergency. Maura said that she had to sign it now to give the agency’s involved more time to prepare. 😆 It must be true she said it on the TV.

Of course us peasants actually realize that it gives them less time to prepare for the implementation of the new law.
