NH man arrested, Guns seized and charged for not breaking the law

"He was shooting a small tree in the ground around the tree," Doty said.

Police seized nine guns from him. He was arrested and later released.

"It is not illegal to shoot in there. However, based on the totality of the circumstances, the timing and everything else involved, that's where the charges were derived from," Doty said.

Police are not releasing the identity of the man at this time, but he is facing charges.

"Right now, he's looking at charges for reckless conduct, disorderly conduct. And there are more to come," Doty said.

Any normal person hearing the gunfire would think he was a poacher jacking deer, so it doesn't surprise me someone called the cops.

So what. They have no proper charges. “Totality of circumstances”. BS.

Called in other agencies, stopped traffic. Now they have to charge him because it demonstrates what useless f***s they are.

I could maybe see the argument for disorderly conduct given the time, but how do you charge him with reckless conduct? Shooting into a tree stump in the middle of the woods is not endangering anyone else. Also did any member of the public even call the police to report the gunshots? If not then who is being bothered?

That’s why I don’t open carry in public. MA prosecutors will happily stick disorderly on you, simply because they don’t like guns and can get away with it.

The question is: Would they have done the same if they pulled up at 7:36pm? It's just as dark. Is it the dark or the hour? I could see the hour being an issue IF there were other houses and such nearby.

Poaching deer with Rapid fire/ automatic sounding firearms? Poaching deer is probably not anyone’s first thought. Not unless the deer were maneuvering on his position and his teammates were already hit.

IF there is a zoning law that prohibits it at that time. If not, then legal is legal. If someone doesn’t like it, they can try to pass a law. But we can’t be arresting people for legal activity just because it doesn’t occur to us as normal for a certain time of day.
 
No doubt. I think it's a BS charge in teh first place (it's a WMA for crying out loud.) Sounds like pissy-britches cops that got woken up to do their job as opposed to wandering in there with a WTF for hte guy.

Under section 3 he would have to knowingly be causing a breach or inconvenience which he probably didn't know, or he would habe to create a risk by making loud noises which can be heard in public/private which would disturb...

It's that or part that's going to get him. I'd argue if the only complaint was by the police it wouldn't apply, but he was making loud noises in a place which can be heard in a public place at the very least, and those noises would disturb a person of average sensibilities if there was such a person there..

I read it as “near” the WMA. If it was “in” the WMA he’s F’ed I’m pretty sure. Pretty sure no night shooting in a NH WMA

I know night hunting is allowed for certain species but not sure if theres windows and bans etc.

The board went into nonpublic session under the state's Right to Know Law under (a) the "dismissal, promotion, or compensation of any public employee or the disciplining of such employee, or the investigation of any charges against him or her" and (c), "matters which, if discussed in public, would likely affect adversely the reputation of any person."

Also listed in the nonpublic session was (g) "Consideration of security-related issues bearing on the immediate safety of security personnel or inmates at the county or state correctional facilities by county correctional superintendents or the commissioner of the department of corrections, or their designees."

Selectboard Chair Jennifer Jones said she could not comment on personnel matters.

"We in Brentwood have a policy that all of our personnel matters are discussed in nonpublic sessions, and that applies to this personnel matter as well," Jones said. "So, at this point, we are not offering additional comment."

She would not comment if the Oct 9 emergency meeting was in regards to Clement or Ventura. She did confirm both are being paid while on leave.
