NH man arrested, Guns seized and charged for not breaking the law




What a POS ... charging the dude, really?

I always say, never under estimate how people will f*ck up your life for their own gain.

"It is not illegal to shoot in there. However, based on the totality of the circumstances, the timing and everything else involved, that's where the charges were derived from," Doty said.

Police are not releasing the identity of the man at this time, but he is facing charges.

"Right now, he's looking at charges for reckless conduct, disorderly conduct. And there are more to come," Doty said.

So?

Call the cops, fine.
Cops show up, also fine.

The next steps should be:
- is the guy a threat?- NO
- is the guy doing anything illegal? - NO

LET HIM GO. Tell him why it was a bad idea to shoot there.

Take the opportunity to congratulate the officers on a good job, maybe even do additional training, thank the citizen that called and move on.

But they couldn't do that because someone needs to either cover his a** or make a name for himself, so they will f*ck around with a citizen.

There are gunshots around here during all hours of the night lots of times.

Coyotes and raccoons can be hunted day or night. Both get into or around people's chicken coops or around their cattle in their pastures.
Nobody around here would EVER think about calling the sheriff's dept for something like that. If someone is poaching, they'll be gone from the area before any deputy arrived anyway......or they'll use a crossbow or bow and arrow and not make any noise.

Shit like this is exactly why I chose to live as far out of and away from any city or town as I could.
 
Pretty sure there are no restrictions on the second amendment in NH. Even noise ordnances are for music and fireworks etc but firearms and the second amendment are protected.
I’ll try to find the law but it’s illegal for towns to even create bylaws limiting anything related to the second amendment. Only the state can do that.

If this guys gets a decent lawyer he should not only walk away free and clear but could get a nice payday.

No one called the cops.

For those who commented without reading the article first, a Brentwood officer stopped to check on an abandoned vehicle (which wasn't related to this case), heard gunshots in the woods, called for backup, then called for more backup, set up a perimeter and shut down traffic, then just announced over the PA for the man to come out of the woods. Oh, and by that time they already knew who he was, and called him on his phone.

He did, without incident. And they arrested him for being where it was legal to be, shooting where it was legal to shoot, and having nine guns.

A poacher typically takes ONE shot. Shooting is plural.

These cops sound gay.

If I had to bet, they invested all these resources, threw a road block party, and the guy was like lolwtf?, maybe even knew enough to tell the cops to pound sand, but the cops were all bricked up and had to arrest him or beat their wives.
 
Brentwood is generally a no problemo sorta town.

My guess is this is a combination of everyone being dicks, somehow, that we can't read.

NH small town cops, one thing is for sure - they got time, can and do push everything and anything to the limit, make up laws, if they got a hair across their ass. Other times they ignore and refuse to enforce actual laws. Wild west sorta stuff but isn't specific to guns - could be noise complaints, disorderly conduct, resisting arrest (ie questioning arrest), a jacked up truck, a trailer registration, a business being run in a non business zone, parking, loose animals, usually petty crime or non crime pushed to the limit. They got time.

One friend for instance, has both been charged with a DUI after blowing a .05 and the cops continued to try to prosecute it (ie multiple court dates) saying he was probably drunk when he was pulled over but then sobered up in the time prior to taking the test. Same guy got arrested for being in a parked/running vehicle at walmart when a female cop asked him to move from the fire zone he was parked in, conversation started w/ him saying "Listen tuts" and immediately escalated into him being arrested for something petty like disobeying an officer that was eventually dropped. Basically it's a matter of free time and nothing more pressing since we have so little crime - they get pissed, they arrest people and push it to the limit.

Recently in the town I live in and neighboring town, they raided 2 houses with 20 cops geared up swat style w/ rifles and such, over a petty bench warrant and a report that a convicted felon might have had a gun. Destroyed all sorts of stuff in one of the houses, kicked in multiple doors when nobody was home, broke things that didn't require breaking. I don't know the backstory but I guarantee it started with someone being pissed at the dude.
 
Shooting into a tree on the ground sounds like something I'd do when I was 12. Seems pretty weird

In our early 20's a friend of mine on dry roads ended up atop a stone wall in someone's front yard. Cops comment was "you'd have to be an idiot not to think alcohol wasn't involved in this". Probably the same here.

That's pretty funny lol. I'm sure they would have charged him for intoxication aswell. Isn't being drunk and armed a big felony by itself? Lol
