Too late for that. The National ID is coming. It starts to take effect in just 2 years. You'll need a passport to get in from Canada then. Erodes further from there. Patriot Act has some of it.

In this case, Jon, nothing further was found. In the past, there has been some questionable at best Terry searches that brought out evidence of other crimes that would not have been found without the search. 30 years ago, those searches would've been thrown out of court.

Is refusing to consent to a search propable cause? Believe it or not, there are some LEO's that think it should be. BS.
 
I should end with the comment on the stupiditty of the guy assembling the toy gun in his truck.

Was he legal? Yes.

Smart? Definitely NOT. He did help bring his troubles on himself.

Where I feel that things went wrong, again, simply from my interpretation in reading the material and not experiencing first hand, is the fact the regardless of whether it was a toy gun or not, no law was broken or compromised to necessitate such a response or reaction.

Had it been a real firearm, he may be guilty of violating common sense safety rules but stupidity is still legal. I can sit in my vechicle all day long with a rifle in my lap if I choose. As long as I don't brandish it or threaten someone, it's my business. That act does not constitute an illegal search and detainment.

In Communist States such as Mass. I would expect that reaction until the fine folks of Mass. get their illegal laws overturned. However, in remaining free states such as NH and GA, unacceptable.
 
Fortunatly Nickle, I've never worked with a guy like you've described above and I would have no part of it, period.

And you're are right, Terry opened a closed door and it continues to be upheld just as Miranda. Terry is a tool at our disposal and one that is a good tool if applied the way that the SC intended.

Ditto on "dad" being a dummy, he didn't think. Should he have? I guess maybe but hell he wasn't doing anything wrong. But that's what society has brought us to.

Well how do you stop the Madness, Tony? Can you stop it? How do you change it? Again, even if we are law abiding, it seems WE always have to conform to the politicaly correct. Asinine firearm licensing requirements, AWB's, "safe" firearms, it goes on and on. We can't say certain words for fear of offending someone, somewhere, sometime.
As it is right now, don't put a toy gun together in public if you don't want to be staring down the barrel of a gun. I'd love for it to be different.

Because it's a TOY GUN.

Let me tell you something. Most of you know that I do CAS. Well, I've been looking for some metal cap guns so I can be a cowboy at Halloween.

I can't tell you how many stores that I've been in, and when I ask for some old western cap guns, I get this responce:

"You want what? You can't have those, they aren't something that kids should be playing with. And with the No Tolerance in schools, good luck finding them. I don't know why you would want them."

I then say, "So you're telling me that a boy can't dress up as a cowboy for Halloween?"

I then get scoweled at.

I'm still looking for them. So that's the only reason that I can see why a man opening a toy in a car would get him put up against the car.

Jon - I don't have the answer as how to stop the madness. It lies in who we elect as legislators and how we hold them accountable. Beyond that, I have no clue, only a bitch as to our current state of affairs.

He should've taken a moment to THINK of what would happen if some IDIOT saw him take the TOY out of the wrapper.

But then again, I also doubt he actually owns many guns, if any. Most of us here wouldn't think of doing that, outside of Tony and myself, since we live in places where a passerby may comment on your nice looking AR (real one), if you were checking it in a parking lot.

All that being said, I doubt the MORONIC SHEEPLE, living in big cities, yet fearing crime, will EVER change. They're too freaking DUMB, and as I've said before Liberalism is a disease (Obsessive Compulsive). They will not change.
