If you talk to the people who actually deal with the cases, such as the defense attorneys, you will get the real data. The average gun owner is completely unprepared to use force in self-defense.

The standard is a reasonable and prudent individual. So yes, the law in this case follows sound judgement.
 
as of lately or 20+ yrs ago? life is changing fast. what used to be a court of law is now just a mere mechanism for the enforcement of government will. and to alter that you need first to remove all those DAs, AGs and judges that were so carefully installed into their current positions to do exactly the things that they do now.
I am personally aware of at least two SD shootings in central MA that never reached court, both in the past decade. In one case the perp died on the spot and the other case I think he was just shot in the leg. Neither person was charged.

I would think central mass was not infested yet by Marxist/leninist products that this shitty iPhone is programmed to capitalize now to the same extent as eastern counties where we live.

There is an aspect of reporting bias in all this. SD shootings that don't result in charges are less likely to get a lot of media attention.

His social media posts will probably be allowed. Not saying he's right or wrong, but all of this - the posts, the supposed actions at other protests that had people calling the cops on him - is going to presented as him looking for trouble and itching to shoot someone.

I take it that you’ve never been to Amherst, Northampton, etc. There are a lot of very lefty locales in central and western MA.

I would like to contribute experience from late last year, December, in Taunton. A person negligently discharged a round into himself. Taunton PD investigated - talked to witnesses, and I'm assuming [yes, using that word] that they pulled the medical report or spoke to a responding Doctor.

Short version is, the Detective assigned to the task just asked, in a few polite ways 'did this really happen in the manner described?'....and the person who discharged the firearm / was the recipient was given an 'all clear' a few days afterwards. His license was not revoked, nor taken into physical custody, nor were his firearms seized. The firearm which discharged the round [due to trigger being pulled, thanks Alec Baldwin] was returned without any BS.
 
During COVID NoHo had signs along the bike trail that you needed to wear a mask. I ignored it and was not arrested.

Norwottuck Rail Trail then connect to Manhan Rail Trail. The only part that sucks is that you have to go through downtown NoHo. There is one underpass that had many homeless people during Covid, but this year only 1.

My understanding is that we will find out tomorrow whether or not the state will pursue charges against Scott Hayes. The attacker has still not been charged, to my knowledge.

Why hasn't the attacker been charged with a civil rights violation? He clearly used violence to stop someone from exercising their clearly established First Amendment right.

Article from Channel 7 news about Caleb Gannon, the man who charged across the street and initiated the altercation, pleading not guilty to assault and battery this morning.


This article has one piece of information which I have not heard previously. Here is a brief excerpt.

“The defendant verbally antagonized a group people exercising their right to peacefully demonstrate, then escalated his verbal attacks by charging across the street and physically attacking the victim, […] knowing the victim was armed with a firearm,” prosecutor Christopher Tarrant said in court.

So the prosecutor is stating that Gannon knew that Scott Hayes was armed at the time that Gannon charged and tackled Hayes. I do not know if this is true, or how he would have known, since previous reports say that the pistol was concealed. But if this information is true, it could be significant.

If Gannon knew about the pistol, then it would be reasonable to argue that he started a wrestling match to try and take control of it. That would be very different from starting a simple fistfight.

So far it is too early to tell if this information is accurate, and if so, whether it is important. But for me this claim was very unexpected. Everything I have read previously indicated that the pistol was concealed before the altercation, and that the pistol was unknown to everyone except Hayes, who was carrying it.
