"Bicepless man" stated, through non appearing tears, that though he was carrying his Glock Gen4 G27 in his right hand he wouldn't have, couldn't have, shot Kyle due to his medical ethics as a paramedic.

So much fail. He was pursuing Kyle, unholstered his Glock, caliber was .40, wasn't sure if 'there was one in the chamber', thought Kyle was an 'active shooter' buy, yet, however could never shoot in self defense. :oops:

I just caught up to the medic ethic part. The part preceding it where he talked about rittenhouse racking the slide and trying to make that menacing. That whole claim is moronic. He had already fired shots she there was obviously a new round in the chamber and grosswhatever knows this as an owner of a semi auto. So even if he racked the slide to put a round in, that wasn’t an offensive action since there was already one in the chamber.

I don’t think it would matter much but if rittenhouse had put a new mag in and racked the slide, it would at least be open to argument a bit that that action was offensive.

I don’t think cross by the defense will go well for the DA
 
True. Also, if I remember the video correctly, there was a 4th person who was approaching Rittenhouse who immediately backed away and Rittenhouse showed restraint and didn't shoot him. Have to imagine the prosecution is going to have a hard time explaining that one away if they are pushing a lunatic with a gun theme.

Yes, there was a guy whom immediately put his hands up and stopped after the 3 perps were shot and Rittenhouse got up and ran away from him. The guy who kicked Kyle first on the ground ran off before the 3 he engaged attacked.
 
They’re absolutely trying to claim Huber (2nd shot) and grosswhatever (3rd shot but he lived and is testifying today) were heros trying to disarm an active shooting.

Even if the prosecution case is decent for the 2nd and 3rd shot, that they were trying to disarm an active shooter and not acting with ill will, they still have a massive problem. If the jury sees the shooting of Rosenbaum as self defense, rittenhouse getting attacked by 2 and 3 would also be justified self defense. Even if those people were acting as good citizens and trying to detain rittenhouse, he could still legally view their actions as an attack and use force to defend himself. That’s why it’s really stupid to get involved in things that don’t concern you.
Tough for Huber to be stopping an "active shooter" when Kyle was running away from people screaming "beat him up!" while not shooting at the mob on his heels.

In Wisconsin there is no formal statute suggesting that a person can use deadly force (skateboard to the neck) to stop somebody fleeing. So any such claim depends on common law, which does include "citizens arrest" but no right to use deadly force when you didn't directly observe the fleeing person commit a violent felony.

Huber was just joining in mob justice, not a hero.

They need to keep him on the stand as long as possible. He's a terrible witness for the prosecution and the longer he's up there the more damage he does against the state.
The damage is pretty much done. I don't think there needs to be any more nails in the coffin of the prosecution's case. Although a directed verdict is still rare, I agree with the commentators that it is becoming more possible. Not guilty verdict is in the bag.

Nearly verbatim from the trial.

Defense counsel: in this video you were chasing after rittenhouse (as he was running away) and reaching in the rear of your waist where you had your glock 27

Answer yes

Defense: before you reach rittenhouse Huber was attacking him with a skateboard

Answer yes

Defense: when you were 5 ft from rittenhouse who was on his but on the ground, you stopped and had your hands up, glock in in your hand, and rittenhouse didn’t shoot at you

Answer yes

Defense: then you moved towards rittenhouse who was still on his but and you pointed the gun at rittenhouse as shown in this video and still picture and only when you were advancing towards him and pointing your gun at him did he shoot you

Answer yes


And that is “victim” 3 according to the DA and the latest witness to testify in defense of rittenhouse (during the states case). I promise I paraphrased but the testimony was like that. This is the biggest turd of a case I’ve seen and I follow court cases pretty often.

And who cares. The prosecution obsessing on rittenhouse not being a licensed medic with x number of hours of course work is such a moronic issue. There are event all over the country were people with some lower level of training or medical knowledge volunteer to assist in basic first aid if they can. That he only had lifeguard level first aid training is such a non story yet the prosecution keeps beating this dead horse.

It is necessary to show a state of mind of Rittenhouse as being there looking for trouble. This is the prosecution's whole case. That is why they are obsessing over it.
