Has anyone ever been charged for having an unpinned muzzle device on a 14.5 inch upper if the OAL was still 16 inches?

I’m complying with the law.

I have a legal muzzle brake pinned and welded from Noveske that is 16 inches.

If I remove that upper and brake I’m still legal because I have stamps.

As stated in my previous post, I’m not getting the brake removed anyway.

I’m not removing anything.

I’m just going to buy a new 14.5 inch upper that had a pinned and welded muzzle brake from Noveske to make it 16 inches.

All my plans are legal.

Know idea why you think I’m going to prison.

I may be part retarded but I’m not breaking any laws.

I can have any length upper I want as long as it’s not on a rifle that does not have a stamp.

I meant to say I’m getting a new upper with a flash hider not another one with a brake.

While technically that will work, may as well be kindergarten paste. Silver solder is the only fed approved alternative to pin and weld.

Fed AW feature approval is history (does not apply to any current federal law) , and is not binding on states unless codified in state law. And even that can be nullified by an AG declaration that the law does not mean what is says.

At the state level, the pre-ban status establishes what config you may have. The federal tax stamp on a rifles changes nothing as far as the state is concerned. A by product of this is that a SBR is still a handgun, and may lawfully be carried openly or concealed with an LTC (but should be included in the "good luck with that" file)

Why do folks bother with pin and weld anyway? If it's at all inconvenient to p&w, then just buy an oxy mapp torch at Home Depot and some 1100 silver solder and take a few minutes to silver solder the brake or FH on. Can also remove without grinding out a pin too should you decide to change.

Getting my barrel glowing a dull red bothers me for some reason. Arc welding a pin has a very small hot spot that only lasts a few seconds.

Yes, done SS many times both putting on and removing. Easy peasy. Brownells and other places carry the 1100 degree SS. I did use the coolant goop around the end of the barrel right before the threads. The barrel does not turn cherry. Only the brake a little bit. You don’t need acetylene. Just oxy-map. Never had a problem cleaning threads after removing SS either. In NH now so don’t have to do that dumb stuff anymore. But I did find SS to be quite straight forward.

I don’t know the ins and outs. But if so, and that’s something you do then maybe pin and weld is better. Or get a pistol lower when you go state to state if that would work. Just throwing out options. I don’t have a use case to bring an SBR to another state so I would go SBR.

You can request permission to cover a 365 day window, but you need to remember to do it every year. You also are screwed for impromptu trips to other states you don’t normally go to.
