MA Gun Grab 2024: H.4885 - Passed legislature, headed to the governor

Even a 10 year old could tell that this argument is ... lacking. People have been buying and owning those guns since... 1900? At least 1960. It's not like another year of injunction is going to do irreparable harm. If you combine that with all the stats that murder and crime in Mass has been going DOWN, their argument is even more stupid.

But, yea, I know, facts don't matter with things like this.
Unfortunately, we do not have 10 year olds sitting on the bench [laugh]
 
I have been open and crazy busy all day so if this got signed I did not hear. The state website still says on the governors desk for what that is worth...

Default is 90 days to become effective. Emergency order can make it sooner.

I think the only logical effective date is 8/1/24 at midnight (as it becomes 8/2/24). Why?

Because of the grandfather language for ASWs. The language says lawfully owned on 8/1/24.

If they make this effective BEFORE 8/1/24 then most existing semi auto rifles become illegal before 8/1/24 and are therefore not grandfathered.

If they make this effective AFTER 8/1/24 then people can lawfully buy guns that will become illegal after the law is effective and they will not be grandfathered since they were purchased after 8/1/24.

So we won't know until it is signed but logic dictates end of day 8/1/24. Any other choice causes the state legal risk in the shorter term.

We as a group are much better off treating the situation like that - but most here will continue to poke their head up from out of the sand and inquire if their benevolent masters still allow them to keep their special toys.
I can’t stand that meek outlook on this situation. You’re telling me thousands of people are willing to give up their rights? At the stroke of a pen people go from law abiding citizens to 8 year felons. Our children can’t defend themselves and their country like we could because they simply weren’t born soon enough? f*** that. No one on here has victimized anyone else (I hope) so why are we scared? These virtue signaling politicians need a reality check. The state can’t jail all of us, it would be chaos economically, logistically and socially.
 
Most of the original gun control and licensing laws were like the voting laws. They were intended to prevent black people from owning and carrying guns. That's finally pretty much fallen away. States that were hard to get licenses in for various reasons have dropped all license requirements.

FL, which lead the way into the modern concealed carry era just passed Constitutional Carry, although open carry is still not legal. SC also has gone to Constitutional Carry.

Of course the northern states are not non resident carry friendly. Until ME and NH passed Constitutional Carry, MA residents had to get permits to carry there. You know how the RI system works. I'd probably have got a CT carry permit if we hadn't moved.

All of that being said no one craps their undies if they see an open carrier in TX. A good number of businesses prohibit it on their premises, but far fewer post no concealed carry signs. Truth is, unless they have metal detectors or you're really stupid no one is going to see your concealed carrying.

And of course pawn shops in the south are also FFLs for the most part.
The culture in the south has long been "ordinary people carry guns".

Here in the north is has historically (at least in MA and NY) been "only people the police approve of can carry"

So the perceived need to limit the ordinary, unconnected and unimportant person has long been stronger in those locations with a tradtion of "ordinaries" carrying.

I took some action regardless of the potential outcome.

I equate it to when people do not vote and then complain about the elected officials. Lots of chest bonding on this post but if you did not reach out to your state rep and senator throughout this then why are you complaining?

There are too many Monday morning quarterbacks posting rants that have no purpose other than letting them vent.

Surprisingly, my rep voted against it on the first round but for it this time. Ugh
 
While there are many things I am still trying to figure out in regards to all this BS, I keep reading how it’s a ban on almost all semi automatic guns.
After that blip most synopsis go on and talk about rifles.
However does this also ban semi automatic pistols?
Forgive me if it’s been discussed and I didn’t see it.

I knew my calling and letter writing and hand wringing would do no good.

Yes, precisely. But effective date will be 90 days after the governor signs it, since there is currently no emergency preamble on the law. This is the same line of reasoning I wrote here:

Because the bill banned frame transfers. So we can only buy what the state allows us to buy.

New Definition of Assault Rifle, Covers many more rifles.
“Assault-style firearm”, any firearm which is:​

(a) A semiautomatic, centerfire rifle with the capacity to accept a detachable feeding device and includes at least 2 of the following features:
(i) a folding or telescopic stock;
(ii) a thumbhole stock or pistol grip;
(iii) a forward grip or second handgrip or protruding grip that can be held by the non-trigger hand;
(iv) a threaded barrel designed to accommodate a flash suppressor or muzzle break or similar feature; or
(v) a shroud that encircles either all or part of the barrel designed to shield the bearer’s hand from heat, excluding a slide that encloses the barrel.

Section 73 or the pending legislation:
Section 131M. (a) No person shall possess, own, offer for sale, sell or otherwise transfer in the commonwealth or import into the commonwealth an assault-style firearm, or a large capacity feeding device.

(b) Subsection (a) shall not apply to an assault-style firearm lawfully possessed within the commonwealth on August 1, 2024 by an owner in possession of a license to carry issued under section 131....​

I called, I wrote letters all knowing it would do no good, I urged my friends and family and shit even people I barely knew to do the same.
This was hard for myself to keep up on, constantly changing, morphing etc. It felt like the stupid shell game a hustler would play on a city street.

I felt I wouldn’t know what the final crap show would be till it came out. Well the baby was born and for once I agree with the left. This one should have been aborted
 
In what way is a police station used for the administration of government? That's a serious question.
I still remember going through my first LTC appointment. Lthe licensing officer had his rifle sitting against the wall. He also left the room to do something I forget what. But at that point I thought, why did he leave it, why is it just sitting there.

I just was thinking, didn't do anything or ask questions about it either. Almost like it was a trap.

Governor can issue the act as an emergency I think? I think mass legislature punts to executive branch via this mechanism? This happened with migrant housing I believe

At my police station, that's where you go to get the compost stickers to use the town transfer station.

So there ya go.

I'm sure it could be successfully argued that the LTC application, interview, and issuance process is also part of the administration of government.
My town has meeting rooms and the Police station that are used for various board meetings from time to time

Im not sure FS is totally correct with this statement. The law continues:

"...or by a holder of a license to sell under section 122; provided, that the assault-style firearm shall be registered in accordance with section 121B"

Section 121B is the new registration system this law creates, not the "registration" system we have now. This seems to indicate that as long as the gun is legally possessed in MA by Aug 1st, by a dealer or individual, it is grandfathered. That would mean that dealers can sell their inventory but not re-stock. In other words, they dont have to be "registered" in the current system by Aug 1st.
