Can you still carry preban mags as well as purchase after 8/1/2024? What's up with the motor vehicle laws saying you cannot carry loaded high cap firearms. If the mag is preban wouldn't it be exempt from this?

This one is really out there in terms of extremes, even for MA: it's like passing a state law declaring anyone who has purchased or possessed a refrigerator a felon punishable by time in prison.
Serious transgression for the climate creeps if your appliances aren’t up to the latest energy star rating.
 
I am watching these threads with interest. One thing that I disagree with are the snarky replies to people staying in MA, belittling them for not moving out of state. Usually people stay here for either jobs or family. Being retired it isn't the job for me it is family. My 29 year old son is buried here and I have issues with driving long distances to see him every Sunday. I have had people, who have never lost anyone, say dig him up and move him, yeah along with the wifes family and my parents... Also one of my other sons lives here and is not a gun guy, along with his wife and our only grandson. I know of many people who have moved, my own brother moved to SC and is able to hang his ARs on the wall unlocked.
I won't apologize for wanting to sit in the cemetery every Sunday to be "with" my son.

The section 49 summary for LTC says that the possession of large capacity and semi-automatic firearms is banned.
Does that mean ALL semi autos, including pistols? Should I assume that means the ability to buy them post 8/1, and grandfathers currently owned firearms in, right?

Also, I've always have a delayed background check. Could that potentially push something I purchase now past 8/1 and create a big problem?

GOAL is referencing the section in bold (131c). 131a seems to cover what it covers now - see italics. It looks like they’re breaking out that an LTC gets you FID items and large cap items.
Section 131. The issuance and possession of a license to carry firearms shall be subject to the following conditions and restrictions:

(a) A license shall entitle a holder thereof of a license to purchase, rent, lease, borrow, possess and carry firearms, including large capacity firearms and ammunition therefor. The license shall not entitle a holder thereof to transfer, possess or carry large capacity feeding devices or assault-style firearms unless such transfer, possession or carry is permitted under section 131M.

(b) No license shall be issued under this section unless the applicant submits with their application a basic firearms safety certificate meeting the requirements of section 131P.

(c) A license to carry firearms shall be valid to own, possess, purchase and transfer rifles and shotguns that are not large capacity or semi-automatic, consistent with the entitlements conferred by a firearm identification card issued under section 129B.
 
I’ve been thinking the same thing. Someone at the conference committee probably insisted that the 7/20 must be there, but at the same time they realized they wouldn’t get away with it if they retroactively banned everything after 7/20, hence the put in the 8/1/2024 grandfathering in addition. They are probably loving to see our confusion now.
My guess is they are trying to suck up to the governor that wrote it and might be going to a federal position. Nice to have her ear plus in this state everybody moves up one.

I support those who are considering a move and those who chose to stay. It is still a free country and I would never belittle you or anyone else, especially for keeping your son's memory with you.

Except for a 4 year stint out in Silicon Valley I have lived in MA since I was 11 years old. Both my parents and both in-laws buried here. My kids are here and my Grandkids are here. Hard to pack up and leave.

That said we were seriously considering SC but it's to damn hot down there in the summer. Looking in NH now. Getting ready to sell my last rental property and get something up North. My wife can't retire till the end of 25 so we've got a little bit of time.

Honestly I don’t know for sure but the way I read it is no firearms period full stop to be sold unless on the official roster.

Right now there are zero rifles of any kind on the roster as of this moment so effectively you can’t buy any rifle. Once say that Henry lever makes its way to the roster then you can purchase that. I hope I am just being dense/stupid in my interpretation but knowing this state the worst outcome is what they are after.

Well, I hope bolt actions are still ok. I’ve been on the waitlist for an action for 2 months and I’m expecting it in about another month.

Christ...I'll be a free stater with ability to buy anything and even I don't have a huge list. I already have all the hicap mags/ammo I need from me buying and storing down there at my kids place. Will likely just buy a can first off, new G17, And probably build some stuff, like an SBR, some 80% pistols. Ill be getting an AK as well. Probably a Bullpup shotty that takes a mag. Other than that, my list isn't that crazy......

Will be nice to get mail order from anywhere now....that is for sure. PSA, etc....and the obvious no worry about any anti gun communism, storage or transpo laws......thats more to me than what I will be buying really.

Owned ON 8/1/24, not prior to 8/1/24. The difference is massively important.

You can still purchase on roster handguns after the bill goes through. What you cannot purchase are any rifles, shotguns, machine guns, frames or receivers since they are all subject to the roster and none are on the roster

Gold is having off roster handguns and grandfathered ASWs since they remain transferable in private transfers. On roster handguns are worth what they are worth today...

We're talking about the 4473 being completed on 8/1 not prior to correct?
We are talking lawfully possessed on 8/1. We are not talking lawfully possessed on 7/25. If they make the law effective on 7/30 then NOTHING is grandfathered because on 8/1 you would not lawfully possess it. That is the big difference between on and before
 
That depends on interpretation. It may be that as the part that is "legally the gun", a frame for a compliant handgun may be acceptable. I said may.

It is really a matter of what dealers are willing to do (likely issue) and any court decisions or official opinions on the matter (less likely).
I am not sure if the distinction matters or if their is much of a practical use for the edge case but interesting thought

I see no objective way for any long guns to get on the approved roster. The language in MGL 140 123 (o) requires amongst other things, multiple drop tests from different angles. Rifles and shotguns are NOT drop safe. So they cannot pass the test. This means that the method for inclusion on such a roster is the language that allows EOPS to at their discretion add and remove items from the roster. This CANNOT be constitutional on multiple fronts most especially after the removal of Chevron deference. Also good luck proving this is not subjective, open to political hackery, arbitrary and capricious.

Just thought of something to limit risk. Buy one of these and keep in a draw for a rainy day. With this on the rifle it’s no longer an assault rifle. Without a removable magazine it would be categorized the same as a bolt action. Not saying to use it but just have it just in case.



Guys in California used to use things like that. Maybe they still do, I don’t know. But they’d convert the rifle to a fixed magazine. Thats probably what I’d do in MA if that satisfied the requirements (I have no idea if it does). You can always swap it out if the zombie apocalypse happens.

I think this is an unintended consequence of the Bill and how poorly it is written because there is nothing in the Bill that establishes testing parameters for shotguns, etc. Drop testing a shotgun should be fun. The geniuses only intend to make a list of guns you can't own as it relates to "assault style weapons." . Based off my communication with my Senator and my Rep, and others, the didn't even know a firearm was considered a handgun or revolver (primarily). Though nothing surprises me, I would be surprised if this gets enforced as written. A simple "any lever/bolt/pump action rifle" effectively amends this. We are back to square one in many ways with interpretations, selective enforcement, etc.

Amazing how they can have one year to do all of this but never even bothered to figure out what they were doing.

Their goal was to outlaw guns in MA, but since the pesky 2A exists, they couldn't come out and do that. Whether planned or through sheer dumb luck, they've come as close as possible without "saying it out loud".

I see no path to, or realistic hope of improving things in states like MA. There comes a point when it’s too far gone and the demographics are such that there’s no way things will ever change using the same system that you’ve been using.

Right now I have zero criticism for anyone that wants to stay for whatever reasons they give. I respect that. But it’s also true that things will continue to be awful in MA and continue to get worse. And not just guns. So those who don’t have a reason, you might want to move. Life is a very short thing. And it’s amazing when it’s lived somewhere that you love and where you have the right to live as you choose.

The wanted complete control of what we could buy and to that end they defined everything as a firearm and the sales of firearms are controlled by the approved roster which they could add and remove firearms to on a whim.

The other side of that is she doesn't want to be the governor who got the entire MA gun scheme overturned, she wouldn't be too popular. Of course I'm 100% wrong on this more than likely.

Me neither. Maybe she realizes how terrible this is and doesn’t want to risk losing the AWB and rosters completely and permanently.
