Comm2A, SAF, GOAL and FPC file against Baker admin on shop closures

OK, so this lawsuit mainly deals with gun shops, correct? (1)

Are there any that are dealing with closed clubs/ranges (2) and another with license applications and renewals (3), and a fourth with online ammo (and other) purchases (4), and a fifth with well, I know there was a fifth (5), but will get back to you. :)

Hmm.... the prospect of that occurring could influence which phase of a multi-step opening up of the MA economy will gun shops. It's certain that without some adverse consequences for "the system" that gun stores would be the very last thing allowed to open. Bookends - close them first, open them last.

It had a bodyguard when I went to go see it speak once. While I didn’t see the piece the guy looked like typical armed plainclothes.

McCarthy is mostly about shops
Cedrone is also about ranges.

The two are running together now. The judge requested more info to help him understand the "platonic" shooting range so he can make a better judgement WRT how they can reopen
 
What are the next steps in this case? I believe I read here that this current 4 appointment thing is only a "TEMPORARY" order, correct? So, when do more permanent things start to happen? Are there dates set? Are there goals set? What needs to happen in order to see this through to the finish?

Most importantly, what does our side consider a "WIN" here?

The next hearing is May 29. I *believe* that's on the merits. That is, that is the beginning of the actual case.
Beyond that, Cedrone's attorney is supposed to provide info ASAP WRT ranges, after which the AG's office has a few days to reply. That should lead to a PI/TRO that provides guidance for the opening of those ranges. There may need to be additional hearing(s) for that though.

Now that the state is starting to open up next Monday, I wonder if there will be any gun shops that will dispense with the 4 appts per hour and fully open under the social distancing/mask guidelines. If they get closed down, I would think that florists and jewelry stores being allowed to open last week would be a hell of an argument for our side. But is any gun shop willing to rock the boat on this?

In this game anything other than a total judgement for the other side is a win. Remember, we are playing an uphill game against a stacked deck (yeah, I know I mixed metaphors).

There is a very real risk in this, or any other gun oriented case, that an anti gun court will simply say "Summary judgement for defendant, next case please" while your attorney is unable to even argue your position before the court. BTDT.

Yeah I don’t get the obsession with FS. I bought my first few guns there when I was a noob but now there are so many better shops where you don’t have to get crammed in like sardines and take a number.

Generally they have better prices on new guns than other shops, so people who are mainly concerned about price will gravitate there. People who don't want the deli counter take-a-number experience and are willing to pay a little bit more will go elsewhere. Different strokes for different folks.

I live close to FS, in the past have been able to go when it's not busy. Plus I usually go there for deals or when I know what I want. Been going a long time, it hasn't always been a zoo there.

Lol I did a transfer sat elsewhere, it took no more than 10 mins, no way anyone will ever get out of FS that fast. Last time I did a transfer from FS (not by choice, only option i had) it took 40 minutes with no line and no coronavirus.... lmao. The bigs are the path of most resistance, but skinflints gotta flint... [laugh]

Don't laugh, as outdated as the Third may seem, there actually was a recent SCOTUS case addressing a Third Amendment argument. Mitchell et. al. v. City of Henderson, Nevada. Police demanded to be able to use private residences to set up surveillance. One of the findings in this case was that municipal police were not considered "soldiers".

Glad we have a "win" for gun shops opening. So what's the status of ranges? Why on earth are ranges staying closed given the governor allowed golf courses to open? Why would ranges stay closed given the stay-at-home order ends May 18? How does a hearing May 29 help us given the order ends May 18, unless it doesn't?

Sorry, I just feel that at least as far as outdoor ranges go, this is a slam dunk. Private land, private club, not open to the public, Governor has no authority to "limit" the club if members are social distancing. I can understand indoor shooting as that will require a "plan" as far as social distancing, scheduling, cleaning, but outdoor shooting isn't much different than going to the beach, park, or God forbid, playing golf. Meanwhile, the weather is getting nicer and there really is no reason to continue to be cooped up.

Honest to God, this state has the least intelligent legislature and governors I have evern met. Even backward, corrupt, little RI is open...

Four Seasons has great prices on commodity stuff, so if you're a new shooter (or are looking for something that isn't exotic) they will mostly have the best price.

I wouldn't go there for exotic weirdo things, and it's not a C&R haven, but they're very good at what they do.

Plus, because it's very busy, it's a great metric for how the industry is doing.

There are lessons to be learned here. I am hopeful that *should* CoronaV pop up again in the future with a newer, scarier name that *all* clubs will be better prepared to deal with the lock-down/non-essential nonsense that ensues at the state and local level. We now know what's possible...what are we going to do differently next time ?

I've always figured that it was better for me to pay an extra $10-$20 for a gun at my local gun shop then it was to drive the hour to FS and back. Between gas, time driving, time stuck in line there while not even get the chance to be close to the cases, just wasn't worth it. There are 4 gun shops in my local area I'd rather see stay open. Plus Carl isn't the friend to gun owners that every thinks he is. I seem to remember he was all for the ammo ban so we couldn't get out of state ammo delivered anymore. More business for him.
