The guy looked to be at least mid 50s and severely over weight.

Getting thrown to the ground in that condition absolutely could be deadly.

What if the guy had a heart attack? Is it the assailants fault then?

Breaks a couple ribs and punctures a lung?

Full on tackling someone to the grounds who is fat and old is dangerous af for the fat and old person

3. make sure you were at most 22ft away when you shot him

#4 should be “I won’t answer any questions, or make any statements, without my attorney being present.”
 
Logic dictates that gun owners must first offer a firearm to the assailant, then it's ok. Because now it's a duel. Only then does it become a danger of grave bodily injury.

CWOF is Continued WithOut a Finding. At the end of the term it's a dismissal, it is not a conviction and not a prohibiting factor under state or fed law. But they will deny as unsuitable. Move out of MA and it means nothing.

You can’t use deadly force because you speculate that at some time in the future you might be in danger of death or grave bodily injury. You have to be in danger of death or grave bodily injury right now.
If you immediately go for deadly force when faced with an attack that hasn’t risen to danger of death or grave bodily injury, then you are likely to be in a world of legal hurt.
Ponytail struck the veteran from behind, knocking him to the ground (rewatch the video stopping the image immediately after the impact - you're looking at the backs of both, with ponytail on top), driving him onto the concrete. That in and of itself constitues use of deadly force towards the shooter, as there are numerous incidents of individuals dying after being knocked to the ground by an assault and striking concrete. Had the veteran died from the fall, ponytail would have been liable for murder regardless of any actions beyond the initial impact. Following the intial impact, ponytail can be seen trying to choke him, also an application of deadly force.

I wouldn't say it means nothing. Clarke v. US (2016) was a FL District Court case that held that "withhold adjudication" after pleading guilty did not constitute a conviction. That would be analogues to MA's admission to sufficient facts and a continued without a finding. The Federal view is that one is admitting to the factual basis of the charges, but there seems to be limited caselaw one way or the other. US Immigrations routinely held that admissions to fact are convictions for immigration purposes, but of course it could be argued that this is apples and oranges when talking about citizen's constitutional rights.

18 U.S.C. section 921(a)(20)(b)"What constitutes a conviction of such a crime shall be determined in accordance with the law of the jurisdiction in which the proceedings were held." This would explicitly state that you are correct.
