The Conference Committee has sent official language out - h.4885

Unfortunately today’s school shooting is not going to help our cause.
As was said in that thread - something is different today.
Those of us over about 40 grew up with unlocked, glass front gin gun cabinets and did nothing.

If we can retain SCOTUS, we retain our rights.
If not, we all know the end game.

My parents didn't have any gin cabinets.

😁

Gun cabinets, gin cabinets
Won't say I didn't raid at least one of the two...

By the time I was 16, I had a glass front gun cabinet in my room with around 12-15 guns in it (I mowed/raked a shit ton of lawns and all the money went to guns), it had a light in it and I would leave it on at night so I could see my guns. I even had a couple handguns.

And the crazy part is, I never shot anyone.

His explanation of Bruen's Text, History and Tradition test is wrong. Not just poorly explained but wrong
He first says that you look for a "provision in the Text for the law" and if not burden shifts to the government to show a "carbon copy"
Not everyone is a legal geek but that explanation is way too wrong for the size of his platform.

Correct - no change in private transfers
However, if it's legal now but illegal under the new laws then I can see someone wanting to unload it before it is worthless in the state.

Not trying to be a smart ass here but the only scenario I can think of that would fall under this situation is if someone bought a ASF after 8/1. That would be illegal as of 10/24. I have a few SBR'd pistols that I am taking the stocks off and reverting back to title 1 firearms and selling as of 10/24 as a pistol because at that date Will be grandfathered ASF and extremely rare inside of Massachusetts.

Not trying to nit pick but to be accurate would be more like "if someone bought a ASF after 8/1 that was not legally possessed in Ma before 8/2."

The only way I can see doing that making any sense is if you intend to do rape jobs as a flipper. Otherwise throwing $200 away is retarded.

What's going to be interesting here is that guns stores had hundreds of so called ASF in possession as of 8/1 that they sold to buyers after 8/1. So is everyone who bought an ASF after 8/1 soon to be a felon come 10/23. Take Cape Cod Gun Works for instance. They received two pallets of Spears and other assorted rifles just before 8/1. They sold them out in a couple days after 8/1. What happens to all those buyers come 10/23? Does the State come looking?

No, because they were legally possessed in the state on 8/1, doesn't matter who possessed them.

Not sure what you guys are yammering about because that isn't illegal.

Nothing will happen regardless. Even if it was illegal. You guys keep ascribing competency to these people where there isn't any.

Hardly flip jobs. I've owned these guns since 2020. And if anyone can find them in this state cheap that can be proved as legally owned prior to 8/1 then by all means don't buy mine.
I have 3 SBR'd CZ Scorpion pistols (in 3 different colors) and 2 SBR'd Stribogs. Im not sure why I thought doing so many was a good idea but since Ive moved to B&T and H&Ks PCCs the direct blowback stuff is meh.... I take the stocks off them and they are pistols again and I can sell them as such easy-peasy.

The discussion is what does the law say. Not what will happen regaurding legal chanlanges and lack of enforcement. There have been some post that start off talking about what the law says but mix in what the poster thinks will happen or what they personally intend to do, or not do. This causes confusion.

I want to hear it all, I just think it would help if we all made it a point to be clear, especially when responding to a question.

There are a lot of non-AW long guns that fail the new shroud test
So a person could run afoul of the new ASW shit purchasing now without realizing it.

No, because the way it is written any license holder had to possess it.
And dealers possess a license just under a different section

Mass legislaturethrew a temper tantrum over Bruen.
And then we find out that the SJC actually found their reading glasses and produced clear, binding dicta on how to apply bruen.
So under (giggles) Mass SJC precedent, these new laws pretty much fail and fail hard (more giggling)

This has been asked in this thread maybe 20 times before, and the answer this time is the same as it was the other twenty...

And no, the State doesn't "come looking" under any circumstances anyway. They don't care that much.

Would it be correct to say this is based on opinion/practice/history, but not the law. The law does allow circumstances where they can come looking.

And any misstep, whether it is your doing or not, can bring John Law to your doorstep. IE: a medical emergency, house break in, divorce, red flag, yellow flag, car accident, and on and on.

When John Law arrives you never know what you are going to get. Just like @richc posted in the thread about his friends wife. You might get a nice reasonable LEO, or a JBT. ☹️

Of course they "can."

The question was whether they would, for gunz sold between 8/1 and the effective date of the law. That answer would be a "no."

The question was " Does the State come looking?"
So the answer is, they can, but you believe they won't.

I don't think they will either, at least not for a while. but clarity is important, as is the distinction between can and will.
It's like the distinction between can and should in open carry. Can you open carry? YES, should you???

The state knows better than to manufacture a good plaintiff for our side.
They thought they could do whatever they wanted with Jamie Caetano because stripper and that backfired hard.
Any random gun owner that they go after for something purchased between 8/1 and 10/23 is likely to be squeaky clean.
And the last thing they want is a plaintiff with no baggage
