This should be taken Up in state court. The 1rst circuit doesn’t care about the constitution, especially the 2nd amendment. No chance in hell at winning federally. More money wasted goal. Thanks

Healey Signs Emergency Order to Bypass the People’s Voice
GOAL Prepared to Take Immediate Legal Action
For at least the second time in her career, Governor Maura Healey is about to make hundreds of thousands of citizens into “felons in waiting”.
On July 20, 2016, Maura Healey woke up and held a press conference that changed 18 years of settled law by reinterpreting a single word. That word was “copy”. In an instant, and with no warning, she turned endless thousands of the 2A community into felons in waiting. While she never prosecuted any License to Carry holders, much to the chagrin of the Boston Globe, the weight of a ten-year felony hung over innocent citizens.
Eight years later, almost to the day, Healey signed H.4885 into law (Chapter 135 of the Acts of 2024). The final language of the bill was kept secret until the night before the legislature voted on it. Within a few days, Healey signed into law what would become the worst attack on civil rights in modern U.S. history.
As a result of this historic assault on civil rights, an effort was undertaken to bring a repeal of the law before the citizens of the Commonwealth. If enough signatures were gathered, the entire law would have been suspended until a referendum was placed before the voters in November of 2026. Because it was clear that volunteers were well on their way to collect the tens of thousands of signatures necessary, the Governor pulled a very rare maneuver. The radical move was to attach an emergency order to the new law and thus circumventing its suspension, regardless of the will of the people.
“Ever since this tantrum against the Supreme Court decision Bruen started last year, the so-called ‘process’ has become even more putrid,” said Jim Wallace, Executive Director of GOAL. “At every turn, the legislature and now the Governor, have avoided honest public input, especially from the 2A community. We are the only stakeholders involved and there is a consistent effort to silence our voices and mislead the general public.”
Knowing the history of Governor Healey, GOAL had already begun to draft a complaint to go before a Federal Court. We hope the court will take this up immediately, and place an injunction on any enforcement.

No, the law says that in order for a dealer to transfer a firearm it must be on the roster.
The law updated the definition of firearm to include rifles and shotguns.

Guida is spouting bullshit.
Unless EOPSS updates the roster to include language like "all long guns and shotgun not otherwise prohibited", then nothing can be sold per the law

Yes. However, you will not be required to register your firearms into the new registration system until 10/23/2026. The Commonwealth is working on building the registration system and will provide additional guidance at a later date on how to register firearms.

Gives people 2 years to either; get out of MA, figure out some sort of work around, decide they won't comply or wait for the courts.

2016 did not turn anyone into felons in waiting. It was just a letter.

But whatever, that doesn't matter anymore.

Yes. Federal court is a guaranteed loss the entire way, and SCOTUS is not gonna take this up. In State court you have a better chance of getting a favorable outcome, especially if you file somewhere out in Westen MA which leans more conservative than Boston

And that may be the only thing that stops her from doing an emergency preamble. Once she declares an emergency most of the bill goes live. I don't see any way that banning whole swaths of firearms in common use could survive a court challenge, even in this hellhole of a state.

Imagine if a similar bill concerning the 1st amendment had been signed into law banning modern methods of communication. No free speech on computers, radio, etc. But hey, using a Gutenberg press is on an approved list, so we're not infringing your 1st amendment right of free speech!

I almost want her to issue an emergency preamble because I think it will be found a massive overreach.

It doesn't matter where in state court you file, they are all bound by Canjura.
And by my reading all of the roster shit and ASF fails on its face before that case law.
 
I hope the people behind the petition are willing to change gears and spend that money on litigation instead. This move was doomed to backfire.

Let me clarify: what I’m saying needs to be filed is an action against the governor’s emergency preamble, I’m not talking about the actual merits of the case. There is no basis for the governor to declare this an emergency, especially when the legislature had the option to add an emergency clause to the bill but refused to do so

It already happened.
 
I know if this was posted as I don't have time to go through all the posts, I was told today that as of midnight tonight that all the gun stores in Mass. are going to close their doors until this straightened out. Just passing on what I was told.
