Emergency Preamble to be signed Weds?

Let me clarify: what I’m saying needs to be filed is an action against the governor’s emergency preamble, I’m not talking about the actual merits of the case. There is no basis for the governor to declare this an emergency, especially when the legislature had the option to add an emergency clause to the bill but refused to do so
Read the Mass constitution, the language is so open she can state the reason was she hates every gun owner and wants them dead immediately.
And that passes muster.

We have ZERO path to victory on the preamble. ZERO, none, zilch

The lack of a basis for her to make it emergency legislation has zero impact on her ability to do so, nor the fact that there's nothing that will stop her from doing so or undoing that action.
 
This. I don’t think people on here have read the ruling, let alone understand the value of the language in the ruling.
I've posted relevant language along with an annotated copy of the opinion.

There's a lot of gun owners who are absolutely clueless regarding this BS. I've talked to several of my gun owning friends and they're like "what new law????"
I spoke with a friend this morning, someone who's pretty conservative and helped me get my start w/ firearms in MA. "What new law?" Fortunately that was followed by "I'm right down the street from them, I'm going to sign the petition NOW"

This should be taken Up in state court. The 1rst circuit doesn’t care about the constitution, especially the 2nd amendment. No chance in hell at winning federally. More money wasted goal. Thanks

The MA Supreme Court once ruled that the 2A doesn't apply to MA residents.

Federal court you have to start at the lower courts first and appeal up to SCOTUS.

As we have discussed here many times the Left is well aware that this process takes years and they bank on that for keeping unconstitutional laws on the books.

Bruen was denied in the lower courts before the SCOTUS ruled in favor of the NY club.
 
I know if this was posted as I don't have time to go through all the posts, I was told today that as of midnight tonight that all the gun stores in Mass. are going to close their doors until this straightened out. Just passing on what I was told.
If they were smart they would get together and do just that and show a united front saying they were all shut down immediately.

But I doubt that....history shows it will stay a mosh pit of confusion......

I'm not holding out hope, but the recent pro 2A decisions from the Supreme Court may hold sway over them. Actually If they don't side with gun owners it may help Fastrack to the SC.

We shouldn't be starting rumors, as hard as that is here on rumormillshooters.org

If you have a citation for that, now is an appropriate time to share and would be appreciated. Perhaps an actual ffl will chime in, but with the state eviscerating their livelihood enough already I cannot possibly fathom all FFL's shuttering in place and shutting down tomorrow until this gets straightened out. That could take years and people have lots of time, money and other things invested in their businesses. I doubt they are just going to close the doors and go on without a fight or game plan.

Have you been paying attention to what has been happening in Mass courts?
NH residents getting carry without a permit charges dropped?
The SJC not only applying Bruen but creating a clear and constitutional standard of review for arms cases.

Yes, this will take some time but the state knows that they are going to lose on most of the ban provisions.

Just 4473 and they walk out the door, or they don't sell at all without some kind of direction from the State. Which will never come.....

Things unfortunately are not going to change. A large group of younger Americans believe the Constitution is outdated and not fit for the world we live in today. That means as they get older they will push for change. I may not see it in my life time, but I see a Constitutional Convention in our future and the outcome may not be to our liking.

I don't disagree. Those that believe the Constitution will save everything will be in for the shock of their lives someday. I have said this here many times over the years. I have has several young Leftists tell me that its already over, once you older folks die off we will change everything.

This is from the FAQ sent out by someone in the state that was posted here:

"Licensed firearms dealers may continue to sell firearms contained on
the rosters.1 Upon formation of the new Firearms Control Advisory Board (FCAB), the Secretary
will consider any advice or guidance the board may offer and will approve any amendments to the
rosters as necessary."

So they are saying roster pistols and ONLY roster pistols can be sold by dealers until they get off their ass and form the silly board.

we're talking about people who last week slipped a provision into the budget bill amending their "perfect" bill to fix the issue they created in chapter 135 in their haste in regard to new training requirements which they suspended. You really think the efa-10 system/site will just vanish tomorrow. These people could forget to have someone do that for decades, it's state government we're talking about. Any the likelihood they remove anything up prior to launching their new system is slim to none. But I concede your point, we will find out shortly. 7 hours and 57 minutes from now to be exact.
