New language defines firearm as "a stun gun, pistol, revolver, rifle, shotgun, sawed-off shotgun, large capacity firearm, assault-style firearm and machine gun" but in no way defines most of these terms. So that leaves them to either common definition or to the federal definition. A lawyer will have to chime in on what a "pistol" means under MGL once this goes into effect. If federal definitions of the common terms apply, than "other firearm" under federal law will escape the ASW definition and therefore possibly still be legal and sellable.

Sorry if this is not the correct forum for this question.

I remember reading somewhere that someone who couldn't process firearms in MA got a charge around failing to register the firearm dropped.
Under the 5th Amendment, as in doing so, he would have incriminated himself.

So, if someone owned a bunch of lowers purchased years ago and decided to build one after August 1st, could they argue the same if they failed to register them?

Just a thought: I wouldn't want to be the first to test the theory.

I specifically looked for this because I read CTs newer ban bill that passed and they made sure to define Others.

Unfortunately not accurate. The language in 121B is "All firearms possessed, manufactured or assembled in the commonwealth shall be registered in accordance with this section". Then it says "(2) Firearm registration shall be completed at the time of firearm import, purchase, acquisition, manufacture or assembly; provided, however, that a firearm may be:" and then lists longer time frames for things like inheriting or moving to the state.

So based on this, you have to register at the time of import into the state any gun you purchase out of state.
 
So before this becomes law the senate has to accept it without revisions and then the governor has to sign it into law correct?

I see, missed that spot. So the change is that there is no more 7 day window for bringbacks.

Yep. I actively defended cops before, once they dropped their opposition I went full NWA.
There's cops / as individuals / who i respect.

Then there's cops as political entities (union institution hacks, mcopa, etc) who i have unlimited disdain for. Most of the individuals i referenced above don't like them either despite the fact that they are supposed to "represent" them.

Unfortunately the former tends to have little influence over the latter. Good cops tend to avoid political bullshit at all costs, which usually is a sound idea, however it ends up costing them in circumstances like this.

What's that saying

"Just because you don't take an interest in politics doesn't not mean that politics are not intreseted in you. "
 
If all ARs become "assault style weapons" and the whole pre-ban thing is going away, does this mean legally possessed lowers can be built in a pistol configuration?

I like your thinking... I'm interested in this.

Also, what happens to say an MP5 in pistol configuration, does the 50 oz weight restriction still hold?

Change your mindset. Decide you don't want to be confused anymore. You do that by deciding this new bill can go screw itself because it's an unconstitutional infringement championed by people who hate you and want you to give up your lifestyle.

Don't let them win. This bill needn't bother you. Go on living your life in peace and safety, and let the chips fall where they may. I understand you've been conditioned to believe laws must be followed, but it's time to reprogram yourself: some laws are bad. So don't worry about following them.
 
The MA claim is that an FOB sale in which the common carrier delivers the product to a MA address takes place at the point of final delivery, not the point of pickup where title and risk of loss of the product passes from the buyer to the seller.

I remember reading a news report about a case where the AG collected a $70K fine from an out of state dealer who was shipping BB guns into the DPRM.
So MA is redefining the Uniform Commercial Code. Good to know they have international jurisdiction.
 
They have fcked over dealers/FFLs also. We are no longer exempt from the AWB or mag capacity restriction. We cannot import into the state any ASWs or LCFDs. So being a FFL does not enhance your collection in any meaningful way any longer under the new rules
The 01's would be subject to that not the 07's from what ive read.
 
Well now that post 98 Glocks can’t be sold, what will this new law do to pre October 23 1998 Glocks?

They are now the only legal to transfer Glocks.

Will prices go up??!
